Resolved Question: Fire Inspection checklist?
My husband is in the proses of adopting my son and we got a paper from the lawyer that we have to have filled out by the fire dept after they do a home inspection. When I made our appt for the inspection he asked if we got our checklist so we were prepared ut I didn’t and he said he would just tell us what is wrong when he is here. Well I don’t want to have fo him to come back when we fix things so can anyone tell me where to find the checklist I need because I have looked everywhere and can’t find one. Thanks for the help.

I know it should be common sense stuff but I know also from working in a daycare that for things like thing they are a little picker about what you have and don’t have. One thing they said when I made my appt that was on the list was that the exits of the house are marked….come on how many ppl have the exits of ther home maked with exit signs….thats why I would like a check list

Resolved Question: Non paranormal explanations for “cold spot” in room?
There is a regular ordinary room. It used to be a bedroom but is now a family den.

For some inexplicable reason there is a section of the room that is 2 deg C colder than the rest of the room. The cold section is the exact size and shape of the bed that used to stand there (There’s a book shelf and a gaming chair there now). If you move a thermometer (digital, or mercury) into the cold sport it will drop in front of your eyes, but if you move it an inch to the side (outside of the cold section) it will go back up again.

If you use a thermal imaging camera (Local hardware store that rents them out for nighttime wildlife tours) you can see the cold spot clearly. And it’s the size and shape of the bed that use to be there.

The wall behind it is an internal wall that backs on to a heated room, and it’s not cold to the touch. A smoke candle shows that there are no droughts in the room (The windows are double glazed and sealed, there is no AC and no vents of any kind).

The cold spot is in direct sunlight a lot as it’s south facing.

The floor under the cold spot feels the same tempreature as the floor in the rest of the room (It’s shag carpet). There is a heated kitchen under it, the same as the rest of the room (No cold spots on kitchen ceiling or in kitchen). There is no crawl space under the floor, and no cold water pipes or anything that might cool the room down.

Strangely, an infrared thermometer doesn’t register the cold spot at all, it just reads the wall behind it (which is normal tempreature). But it does register that anything put inside the cold spot is about 2 deg C colder than when the object is outside of the cold spot.

I’m familiar with the paranormal explanations (I’ve never seen a ghost, and I think that the supposed hauntings that you see on TV bunk) but what are some non paranormal explanations?

Nothing “bad” ever happed in the room. Nobody ever died in it or anything. The house is a new build, less than 5 years old and nobody else ever lived there before. The bed was new, too. It’s now in another room, and it seems perfectly normal. No cold spots or anything. The land that the house was built on is perfectly ordinary land. It’s not Indian land, or anything like that. Before the house was built it was just scrub land. And there is no record of anything “bad” having happened there.

Spot has remained cold for the last 3 months, ever since the bed was moved. The tempreature difference between it and the rest for the room is constant day and night, summer and winter.
Moving the bed back does nothing. Still cold.
How is it even possible to use a mercury thermometer incorrectly? You put it in the cold area and watch the level drop, you move it out and watch it rise.

Same for a thermal imaging camera designed for tourists. There’s an on/off button and a zoom control. That’s it.

By using this, breast exams for females can give them upwards of 6 to 7 years early detection of illnesses or diseases. I need to let as many females know about this as possible, what would be the best way to get this in front of as many females as possible. You know if you ask a female if they know of anyone who has had breast cancer, you will find that they have either had it, know someone who has had it, just diagnosed with it, or have lost many friends or family members to breast cancer. Open Question: Tips on placing an offer on a mobile home?
I am a first time home buyer about to enter negotiations with the seller of a 1972 mobile home situated in a mobile home park. A link to the property is below.

The owner is willing to finance the home and the realtor say the owner would consider a lower offer. My question is how much I should offer with out insulting the seller.

The other agent knows a place where you can transfer title which will
only cost you about $100. A home inspection will cost somewhere between

Open Question: Do I have a case in small claims court?
I had a lease with 3 other guys in a private home. The lease was up in June 2009. I tried to get my security deposit back when the lease was up. The landlord would not return my phone calls and would not give me my deposit back. The 3 other guys stayed there and 1 new guy moved in. They have just now moved out and the landlord gave them a check for $25 dollars and a list of repairs. The new guy that moved in also never gave a security deposit and a new lease was never signed either, not even a month to month one. I was never given a copy of my lease after multiple times asking, I did not receive notice of why I wasnt getting my deposit back, and I did not receive notice that they were going to do an inspection of the property. I am considering a claim in small claims court in St. Louis, MO but I dont want the landlord to try and say I owe her money. Everything I have read about the law says I should be entitled to my deposit.

Resolved Question: How does this letter sound? To landlords agent.?
Dear ……..
We have been instructed to contact you regarding the bond from ……… It’s been 2 months since we left the property and we still have not received our deposit back. The problems Einir originally gave us are as follows;

We were told the carpet in the lounge smelt of dogs. The carpet did not smell of dogs and we have two witnesses to confirm this. We were quoted £100 for cleaning.

The cooker was dirty but not 6 months dirty. We have photographs and two witnesses to confirm this. The cooker was black when we moved in and black when we left. However before we left Sam did give it a good scrub with some oven cleaner. We were quoted £50 for this doing which is an absolute joke.

The garden was perfect when we left but the staff at the Blaenau office did not go to check the house until two weeks later by which time the garden seemed overgrown. We were quoted £70 for this.

Two kitchen doors fell off. You yourself told us not to worry when you came to do the 3 monthly inspection. We also have three witnesses who will confirm the kitchen was a wreck. Most of the other doors are falling off anyway so they’ll fall off for the next tenant. I will be writing them a letter and will stand up in court if you try to take a penny off them. We informed Einir a week after we moved in that one had fell off she replied that Chris would come and have a look. In six months he did not make any effort to come and see the kitchen even though we reminded him at least every two weeks. We told you we were leaving at the end of the tenancy and you said we were welcome back at any time as we were perfect tenants. We were quoted £75 for this which later reduced to £50 then £24.

The bathroom door needed replacing and fitting which we agreed to. After all we did break it. We would like to point out that we paid £25 for a rubbish and ugly door when we offered to buy a very nice solid wood one for £15 and fit it ourselves. This wasn’t good enough for the landladies. We feel the mess your builder made is your responsibility. After all the tenancy had ended at that point and we had left. Also he should have put a sheet down to catch the sawdust. We were quoted £25 for the door fitting.

The Blaenau office Tried to take the full £370 even though all the quotes added up to £320. These were the quotes that Einir gave us over the phone and were written down on the 1st of June when we drove 300 miles and spent £60 in diesel to sort out this mess. We confronted her about this but she shrugged and said “I don’t really know”. The carpet did not smell of dogs but we put some shake and vac down (cost £5 approx for two cartons and took ½ an hour). We cut all the grass which was overgrown but wasn’t when we left (cost nothing but took an hour). Cleaned the oven (cost £5+ for this nasty acid and took ½ an hour work but left it for 4 hours).

After we had spent 2 hours work and spent £10 we called Chris Thomas, he left us waiting 2 hours before he came even though we made an appointment at 3. He said it was all fine and we left to go to the office. Enid wouldn’t log in to the DPS to return our bond, we tried to sort it out but she said she needed to call a few people. The shop closed, we went home and she phoned us a week later to give us a whole new list of problems. These problems are listed below;

The kitchen cupboards (see above) at a cost of £50 which was reduced to £24 after we told her they weren’t getting a penny.

The “rubbish” they said needed removing was a perfectly good mattress intended for the next tenant and the old bathroom door that your workman left. When we moved in there were piles of rotting food and other household mess left behind the kitchen extension, as well as a pile of rubbish in the shed. We have two witnesses to verify that. We cleared this up without fuss. Cost quoted £15

Cleaning of the cooker and hovering of the sawdust your builder left. The oven was spotless, 20 million times better than when we moved in. Cost quoted £10

The doormat was missing. We threw this doormat in the bin because it stunk of urine. Dave thought you should have the money for the new one, I begrudgingly agreed but I’ve seen an identical one in Argos for £3.99 regardless we agree to pay the £10 you asked for.

Bathroom door (see above) we agree to pay £25 for the door fitting.

In conclusion we agree to pay £35 for the door and doormat but nothing else. I am sending a letter to the Blaenau office on Monday the 12th of July giving 30 days notice before I take this to court. If we do end up going to court I’ll be applying for the costs involved driving down there on the 1st of June to fix your imaginary problems. I invite you to try and sort this out before then but I won’t pay anything else other than the £35 I’ve already stated.

Resolved Question: Dealing with agricultural wages so that real Americans (Tm) will work at farms.?
One of the issues with illegal immigration is that American farmers pay wages so low that only illegal immigrants will work for them. Lots of the people who think that people ought to pay a higher “living wage” (whatever that means since many of these illegal immigrants could stay here for years and not only live on that wage but wire money back home every few months). So how about people set up some sort of certification programs and Co-Op where all the farmers who supply their crops have to pay an agree upon “living wage” and certify (with inspections) that they hire only Americans or legal workers. Then we’ll see how the prices of the food will work out since most farmers are making a very slim profit margin already so the prices are of course going to pass to the consumers.

Resolved Question: Rental Business: should a special home inspector inspect an apartment building OR can I use a regular one?
Hi,
I’m looking into buying an apartment building (say 10-plex).
Wanted to ask if I can use a regular home inspector for the inspection OR since it is bigger (10-plex) do I need a different inspector?
In other words, is there a certification called “apartment building inspectors” or is any certified residential inspector supposed to be qualified for that?

(asking about residential use only, not commercial. just more units)

Resolved Question: Did I do the right thing to “walk” from this house purchase due to septic issues, even w/lower offer?
It was a small vacation house, offered price $129, it had been over 6 mos on market, they paid $120 in 2007, I offered $98K they countered $110K but I had to pay for septic inspection.

I drove 3.5 hours to be there for the inspection, concrete lids were removed, both tanks filled to brim with mostly water very little “scum”. The septic guy tried to snake the 2nd tank to see if it would flow, nothing. They were going to have to return to snake it, owner said they’d pay for that. It was the first time I’d seen the house on a rainy day, the yard had some standing water in it, your heels sunk into the grass, the “rat slab” foundation under the house had a little bit of standing water on the side by the septic tank, the septic tank was about 5″ above grade from the slab. The septic guy there at inspection mentioned $13K to $16K to repair, but wouldn’t need a new permit as it was a repair.

I went home, talked to some people, they said it sounded VERY BAD like septic runoff and a saturated drain field that was not draining. They said the soil could be polluted with fecal coliforms and viruses and it’s a horrid soup. They said I could not only be out the cost of a new septic, but have to dig out the contaminated soil, have it treated before dumping, and put in clean soil, need new permits, plus septic, plus re-sodding. Another agent I’d happened to talk to a few weeks before this had mentioned a “septic problem” with regard to this house, but my agent minimized that as untrue because the house had been solid for decades.

I decided based on all of this, that she knew there was a septic problem, that she and the listing agent thought if I had to pay for inspection I might go cheap and just buy it without one. I don’t feel they disclosed the problem, that they had to have known about because the yard has standing water, errr, liquid, as does the foundation slab and another agent seemed to know. Further, the county is REQUIRING septic inspections passed by January and I figure the owners must be motivated to get out before they get fined for not passing certification–and that they likely cannot pass certification or they probably would have by now. I don’t feel I should have to pay for the inspection, and they haven’t sent me a bill……yet.

That night my agent came wrote to me and said that we could offer $20K less if I forewent any more inspections. That raised my suspicions that the problem was as grave as I was told, i.e. about contamination, runoff, neighbor / health liability, EPA, county certifications, etc.

Should I contact the county about this house septic runoff and ask if it’s reparable?
Any one with experience with “crappy” septics?

I wrote to my agent stating the house failed inspection and I wanted rescission of my offer and refund of earnest monies.

I love the house/location, but I don’t know if I should have offered mass less, or if my friends were right that this was a haz-mat nightmare???

Resolved Question: Charging customers for Home Inspection?
I am starting my own Home Inspection company very soon. With the average home inspection taking 3 hours, as a promotion deal for a while at least, no matter the size of the home. Do you think I would be ok charging $250 per inspection for about 3 months. I will be working form my home office with no other employees. Would this be an offer that people would take?
I would be doing a general home inspections. I am going to advertise with realtors since I would be new and see if they will take me up on the deal. I am a certified home inspector.

Resolved Question: Issues with turning over keys to rental and time period to return security deposit?
Lease (and state law) states landlord has 45 after tenants vacate property and turn over possession to return the security deposit.

The landlord wanted me to leave the keys on the porch, which I told her I would not do (for obvious reasons prior to an inspection,) and that I would meet her to hand them over or drop them off at the office. Since we moved to the landlord’s city of residence, she said she would come by our new home to pick them up, but ended up not doing so for several days.

Do I need to start that 45 day count down from the day she actually picked up the keys from me, or from the day we moved out and I offered her the keys (with exception to leaving them out for anyone to take?) Today is the 45th day since move out and they have not even approved the security deposit check, so I’m wondering if I can send the certified letter of request for the money now or if this escalates to court they are going to claim it from the day she picked up the keys. (Which is really only 2 or 3 days from today…I get the impression they aren’t interested in returning the money.)

Open Question: In the words of a relative of mine, how do I know my real estate agent isn’t paying off the home inspector?
I think that sounds like a totally outlandish question, but a close relative of mine who IMO is jealous of the house I’m hoping to buy asked me how I knew that the real estate agent wasn’t just paying off the home inspector to make positive statements about the condition of the old (it was built in 1908), very large house. I said that there are legal criteria and professional codes of conduct that inspectors have to abide by and that lenders would be shooting themselves in the foot to have corrupt inspectors give false positive information about houses, but I wasn’t sure what else to say. What kind of legal recourse is there if it’s found that an inspector has fudged the details of an inspection to make things sound rosier than they actually are?
My Take, this is the first house I’ve ever bought and I’m not a maintenance expert. I don’t feel comfortable giving a professional assessment about which home inspector I should use.

Open Question: Move or not to move, that is the question.?
My husband and I are currently living in Virginia Beach, and we hold decent jobs… Well for us anyways. We’re housekeepers at the Hilton Hotel. Our rent is 900 a month plus electric, gas, and internet. In December our lease is up, but we plan to go to school a state away in January(so a job as a housekeeper won’t be considered ‘decent’ pay anymore). There’s a possibility of us going to live with my parents in September, not have to pay rent, just clean and take the trash to the dump. I will find a job, or continue on sewing, selling my novelty hats and sweaters(which I can make more money off of because I’ll more time). The main goal is to save up $1000 or more before we move in January. Which I can do without moving to my parents house, but would be easier and faster, with the possibility of saving much more by then. Should I move and break the lease?

A few more things I have to consider.
My plates for my car are registered in NC, where my parents live and they expire at the end of August. I know if I move (at least by the end of August) I can just renew my plates. If I can’t I have to spend money on an inspection, registration, title transfer, new state plates for Virginia, and license to only have it changed in Jan again.

The early termination clause in the lease states I need to pay any outstanding rent(which we have none, we never were, never will be, late on a payment) and a termination fee of up to two months rent, which for us will be 1800.

We don’t have that kind of money, we’re living paycheck to paycheck as it is. I could try and get a loan but that would seem a little redundant because I’ll be applying for more loans for school come January(though I do plan having a part-time job while I go to school). The idea however is still in my head if I can do it. I have no credit history except for the very little I have built up since Jan of this year with internet and electric in my name, and my name on a lease. I’ll probably more likely get one if my husband and I co-sign on one with our bank, Navy Federal.

My mom is sick and would appreciate the help around the house, run errands, and drive her to doctor’s appointments.

Not as important, but I also miss my friends and sometimes get lonely. Having a little vacation spent right before I plunge into four years of college sounds really nice to me. However, I’m willing to do what ever is best for us.
P.S. Getting married is actually helping me pay for school better. I’m not 24 yet and my parents made over 100,000 last year, so there’s no way I’d get financial aid. This way it’s based off our crummy income.

Open Question: Is it worth it to buy a home that needs to be remodeled?
Ok, my husband and I are looking to buy a house. I just walked through a foreclosure that is at what seems to be a really low price. The house needs a lot of work. It needs total air conditioning installed. it needs all new flooring, some new doors, and a little drywall repair. The roof may need some touch ups as well. Bathrooms need updating, but the kitchen is in good shape. Obviously if there were any even more major problems we would find out in the inspection and walk away. There is also a huge in ground pool that is shot. They have it drained right now. But as long as the structure of the home is solid, the home is awesome…great layout, tons of space, huge lot. A little old, built in 1948. With the low price, we would be able to put a much smaller DP and then have a chunk of cash to fix it up. Then we would have this great house, and a tiny mortgage. And with as low as the home is priced, we would instantly have at least $100,000 in equity. SO my question is…would it be more headache than it is worth to buy this place and fix it up? To do all the repairs. I love projects, but my husband hate that stuff, and doesn’t like the idea. I can’t help but think that we could make it so beautiful…but is he right, is it too much of a pain? You who have done some fixing up before, what do you think? DO you wish you would have just bought a home in better shape?
We would not be doing much of the work ourselves…we would hire most of it out. We’d pretty much be doing the painting and thats it. Also, my husband is completely not Mr. Fix it…doesn’t know how to do any of that stuff, and doesn’t want to know.

Open Question: Home Occupation Zoning and Permits: Can there be two business run from my apartment?
I live in Forsyth County in North Carolina.

I’m starting up two LLCs in Forsyth County in North Carolina.
One is an photography business and the other is a graphic/web design business.
I will meet clients away from my apartment for both businesses.

My question is if both can be run out of my apartment in my county?
If so, do need to file one or two separate forms?

Open Question: undisclosed frame damage?
I live in NY and a few months ago I bought a car from a used car dealership for $15k. At signing, I was shown an Autocheck report that said I was purchasing a clean car. There were things on the car that were supposed to be fixed prior to me picking up the car. I got the car home and realized the brakes were locked up in the back, the emergency brake did not work and the front two tires were completely bare. The car should not have passed a NYS inspection but there was a new sticker put on. I brought it back and had those things fixed. A week later I had my own mechanic check out noises I noticed in the car so i could let the dealership know what needed to be fixed. They insisted two seperate times after me bringing it to them that my mechanic was wrong and there were no problems with my car. At the signing I was also told the window tints were perfectly legal and I would have no problems. Two weeks after getting the car I was pulled over and ended up with $100 fine. I was finally sick of dealing with them so I tried to trade the car in and got a carfax report and found out that the car had been in a serious accident a few days after the first owner bought it and it had structural/frame damage and I couldnt trade it because it was worth about 1/4 of my loan amount. The dealership where I bought the car said it was probably a mix up so I called DMV and they ran a report to find carfax is right and there is frame damage to my car. Is it worth the time to get a lawyer and try to fight this or will I be wasting my time? I dont think this will be covered under the lemon law so what other rights do I have in this situation?

I have already tried working out a deal and they want nothing to do with it. They keep saying they have a no buy back policy and will not give me anything back for it. I threatened to write letters to the attorney general and the better business bureau but it did not get me anywhere.

“What is it about buying a boat that makes people leave their brains at home?
Just curious… It seems every year about this time, (just after boating season starts). We all start hearing from people that just bought (both new & used) boats that don’t float, don’t run, don’t start, don’t stop, don’t plane, don’t turn, don’t tilt, etc. etc. etc.

I don’t know about you guys but I really feel sorry for these (mostly) novice first time boat owners.

What do you think? Are these people just leaving their brains at home when they go shopping for a boat? Or is it something else?

I was early retired 2 years ago and decided to go for a job that I ‘wanted’ to do rather than one I ‘had’ to do. I went for a job making sandwiches for a catering company… but they said I wasn’t ‘cut out’ for it. Seriously! So I went back to my original profession and am now back working as an HR Director, on far more money than the owner of the sandwiche concern.

If I choose to buy a boat and ‘have a go’ at sailing it…. then I will do so. I don’t care what so called experienced ’sailor’ moans about it. I have also been a health and safety officer for many years… so don’t give me the old twaddle about everyone but you being a danger to all and sundry.

People buy boats because they want to, and are entitled to do so.

If you don’t like it… get a skateboard.

by Havoc Squad / Some certain circumstances of issues yes I do feel sympathy for used boat buyers, especially if its a very big problem hidden that a professional inspection misses.

However, for most scenarios of used boat purchasing, I got zero sympathy for burned boat/PWC buyers.

#1. People let the anxiety or adrenaline of boat buying and desire take top priority over their brain.

When this happens, people bypass doing research or verifying the quality of the vessel and get tunnel vision about the price or appearance of it.

#2. Impatience which also relates to #1.

Those with no training or experience in proper used boat shopping are most likely extremely impatient. Unless they have a large budget, rushing to find and buy a used boat always increases likelihood buying a lemon.

#3. Lack of wisdom

Most beginner used boat buyers do not understand the maintenance and repair hazards that could be hidden in a boat/PWC purchase. They also usually don’t understand how expensive marine repairs are as well.

Those are my three main observations.

by LIMA 45.05.18.77/Beats me. Had a guy last week drag in a mid 80s U.S Marine with a rotten floor and a seized engine he “only” paid $1200 for. I sold him a solid running 90 Ebbtide with a 75hp Johnson for $800 (+ $100 that i have to pay to landfill his boat). This poor guy bought his boat at the world’s biggest marina, Ebay. The problem doesn’t just lie with rookies, it’s pirates who take advantage them also. These crooks should be keelhauled,stretched on the rack, and their genitals set alight. We try to run our business by my grandfathers’ idioms, don’t screw people, and only let them screw you once.
If i could offer the newbies one piece of advice- don’t buy it until you drive it.

Open Question: Home Occupation Zoning and Permits: Can there be two business run from my apartment?
I live in Forsyth County in North Carolina.

I’m starting up two LLCs in Forsyth County in North Carolina.
One is an photography business and the other is a graphic/web design business.
I will meet clients away from my apartment for both businesses.

My question is if both can be run out of my apartment in my county?
If so, do need to file one or two separate forms?

Open Question: Can I win if i sue for non-disclosure of roof condition on a home purchase 6mo ago?
They listed on the disclosure sheet under Roof, “There was a leak 6mo ago but has been fixed and no problems since” exactly. I had an inspection done on the home not knowing what to look for myself and it just says, “Due to snowfall the condition of the roof is unknown” (there was about 8 inches up there). The roof is leaking in 3 different places right now and upon getting up there it is completely SHOT. The shingles are literally just falling apart. They’re curled up in the corners and when it rains bits and pieces of them just wash down the gutters. 2 estimates to fix the “leak” came back as “unable to fix leak. Entire roof replacement needed”

Open Question: Can home owners in Illinois sue me if I refuse to close on the house?
I tried to buy a house in Illinois but had so many problems with the real estate agent and the home owners. I brought home inspection to inspect the house and found several problems. The homeowners said that they would fix everything before closing. Closing came and they didn’t fix anything. Later in the month they said they fixed everything now (second closing time). We brought a home inspector again and the home inspector said they didn’t fix anything again. So later the owners made a deal with me and they would give money instead of fixing it, so I agreed. Just before closing the owners said they want to take the bar from the house claiming it is movable object. But the bar was listed in the flyer of the house, which is false advertisement. My own stupid lawyer who already took money in advance claims that the owners are right and they can move any object movable. So I got fed up and refused to go along with closing the house. I told my lawyer I don’t want to house anymore, because they are playing games. Now they want to sue me for damages? Don’t I have the right to sue them for trying to steal the bar (false advertising)? That is also a crime for attempted robbery. I am the one who should sue for damages not them. I lost my 8 thousand dollars from the government because of the owners. I lost lawyer fees, and real estate fees. They have the nerve to sue me?
Yes the bar was listed as part of the house plus they have pictures and they even told me it is part of the house at open house

Open Question: Safety of a house after Asbestos removal?
We are in the process of purchasing our first home. After an inspection we found out that the heater which needs replacing has asbestos tape around it. The ceiling still has the popcorn on it. We have two small babies and are worried that even if we have a company come in and remove the ceilings and install a new heater after removing the asbestos how safe are we? The house was built in 1962 and of course could be other places right? The house was remodeled with new flooring and the rest of the house is hard wood. Should we proceed with buying or get out now?

Open Question: Neighbors Driveway on my property?
There are three homes to the south of my property that use one driveway for access. At one time, there was a water well on my next door neighbors property, so the driveway crosses over my property line about 15-feet to go around the well. The “new” neighbor bought the home about a year / half ago. He took down the old home and is building a brand new home in its place. He also filled in the old water well with cement. The long driveway (a 1/4-mile long) he and the other neighbors use does not meet current county codes and will need to be “improved” (widened with several vehicle by-passes) for emergency vehicles. This must be done before the new home can pass the “Final Inspection” for occupancy.

Now that the water well is gone, the need for the driveway to come over the property line is gone. Even though their driveway has been there for decades (at least 50 years), things have changed and the driveway needs to be altered now anyway to meet current codes.

What chance do I have of reclaiming this area ? There is no “Easement” or any other “Agreements” that I have been able to find in the county records going back to 1902 that shows permission was granted for the driveway to cross over. Also, all three properties go all the way to the main county road, so its not like this is the only way to access their land.

Looking online under “Adverse Possession”, “Easements” and “Prescriptive Easements” does not seem to answer my question clearly enough for me to proceed. All three neighbors know that the driveway comes onto my land, but say that 10-years has passed so it is now “automatic” that they can use it. But, none have ever paid the property taxes for this portion of land, which came up in my research for being able to make claim to someone elses land.

Open Question: Opinions on Miley Cyrus?
I want to make something very clear-I do not hate Miley Cyrus and I don’t want any haters posting really awful things about her. I just want to know if anyone has noticed that she seems really conceited recently. I mean if you look at the lyrics of “Can’t Be Tamed” she says “I’m hot like that every guy everywhere just gives me mad attention like I’m under inspection, I always get the 10s’ cause I’m built like that.” I was just wondering if anyone thinks that she is really like this, or these are just lyrics that don’t mean much to her. It would seem to me though that she acts like she does believe this… I would really like to hear from fans too and see what they have to say. Thanks!
By the way, I realize that she didn’t write the lyrics but if she truly, strongly didn’t believe that it was right to sing about things like that, she wouldn’t have sung the song. So the real question is how strongly she felt that this was true: a lot, or not much.
Also, I want to remind every one that I really don’t have anything personally against Miley at all. I don’t know her and I have no right to judge her, so I’m just seeing what others think.
Please, no one think bad things about me-I like Miley and I think she’s a good person so anyone who thinks I’m being harsh, I’m really not trying to.
