Resolved Question: Why doesn’t my 10 year home warranty cover anything else beside structure. At 5 yrs. old, a musty scent came.?
I called my 10 year old warranty company who is going to come out and look at my home. I spoke to more than one person on the phone and they keep on saying only the structure or supporting part is covered by insurance as required by the State of New Jersey. This home has a sump pump and yet the new carpeting in the basement smelled like mildew so now I am wondering if the sump pump really works. This mildew scent did happen after an extremely large amount of rain last year 2009.
The person I purchased this home from actually refinanced this home while he was going through a divorce and he got $585,000 when he refinanced the home and his x-wife got $55,000 at closing. She was so afraid of him that she would have given him anything and she did but thought it was to pay off his credit cards but who would give anyone $585,000 worth of credit to someone who makes $100,000 a year and has 3 children and a $3,000 mortgage. I believe he would cheat his Mother, Father, Brother and his new wife and his biological children.
Please advise me if there is anything I can do about this. I am worried that the sump pump doesn’t work and we were not advised of it which in turn caused the mildew scent. The real estate man didn’t try to convince me into have the home inspected and almost seemed to accept the idea willingly. I did ask the wife if there were any problems and she said no. This genius wife turned out to be a real air head when it came to problems as there were many problems like the rain pipes are off on the outside, the fence is too high and our dog can go under it and after we closed the wife gave us two fences that we could use because the fence was two high and our dog could go under it; didn’t she consider this a defect. The real estate agent told me he was the one that found a new microwave and he had the nerve not to get the more expensive one that cooks two ways that was in the home when I purchased it but he purchased a cheaper one that is only a microwave. There were 2 doors, one to the garage and one to the laundry room were almost broken into by the husband and it messed up the doors on one side, there is a broken window in the garage and the shade is missing as there are two windows and the other one has the glass and shade, the shower upstairs leaks, the sump pump may not work, screen is missing on the sliding glass door as a neighbor walked through it and it was thrown away. All of these items and many more I cannot remember would have been addressed by the inspector if the real estate told me to get one but he didn’t try to convince me. The real estate man gave the seller back $17,000 because we knew these people and the real estate man considered him as the finder. The real estate man never told us that we should have another real estate man handling our property and I am pretty upset with what he did for us which was taking a chance for us to have ended up with problems. Another thing the real estate man did was scare us into closing and told us the seller would definitely sue us if we didn’t close that day. He said we would end up losing our down payment which was 20% on a $800,000 home.
Would we really lose the down payment if all of the above mentioned things were wrong with the home and the real estate man called it like new. Everything I found when I did the walk through was made light of by the real estate person. He called the seller about one or two items and the seller said no so the real estate man told us again he is going to sue you if you do not close. We were really scared that we were going to lose 20 per cent of the cost of the home and wouldn’t be able to buy another.
Now I have a real expensive home with a mildew scent in the finished basement because possibly the sump pump which is very large might be broken.
Please I am begging for advise as I am hoping you can help me do what I should do to at least recover enough to fix the problems.
A friend told me to sue the real estate man for forcing us to close when we were walking out by scaring us that the seller would sue and the only reason we didn’t want to close because more problems were made in the home after we put the down payment on it.
This home was the first one we purchased and my husband was overseas at the time. The real estate person called it as new and then at the closing I was upset that the above mentioned things were wrong and he thought all of the items that needed taking care of was minor. It wasn’t minor and they still exist. I am more than angry about the sump pump and the mildew scent in the basement.
Any advise would be appreciated greatly.

Open Question: Can someone inspect and service his own central AC or Heat Pump condenser on the ground outside his home?
In these hard times, I am trying to be economical as I can. Have just installed a new 2 1/2 ton central AC in my older mobile home. The AC contractor is trying to get me to sign up for his yearly ” maintenance plan”, which consists of two inspections/cleanings per year of the outside condenser at a cost of $80.00 each. My neighbor is telling me he has his looked at once a year at a cost of $65, but each time his guy comes, he says there is some additional stuff that he says needs doing,..anywhere from $30 to $130. On his latest visit, he told him there was some green mold inside and wanted $1,500 to remove it My neighbor, of course, refused, got out his garden sprayer, mixed up some bleach & water, and cleaned it himself.
Another neighbor is telling me he just waits for the AC to stop working ( usual time is 6-8 years ), then he calls a service guy who has never charged him more that $200.
Dunno,..am in my late 60’s but still healthy and a do-it-yourselfer,..is this something an average homeowner can do himself ?
Open Question: Can a repo man in Texas do this?
At 2:15 this morning a repo man came and banged on my bar yelling “Providian Bank” Not a bank that I have ever done business with, woke up me & my two kids And was being threatening and aggressive..Telling me to give him the keys to my car or he will not let me have my stuff out of it.
This is long so here are the facts…
My ex-husband & I bought the car in April of 2008. We had the payments taken straight out of our bank every month. It was a buy here pay here deal. The first yr we never heard a word from the fiance company. Never got a statement or anything. Then we separated, I called the fiance company and had the payments switched from my husbands & I joint account to my new sole account. and i paid on the car for another yr and heard nothing. Never got a statement. Then when our divorce was nearing the final stages, i knew I could not longer afford the car. So I went to trade it in at a local dealership. I took my paperwork with me cause i had tried to call the finance company to get a pay off and every number I had for the finance company the dealership i bought it from was disconnected. The car dealership i wanted to trade it at was puzzled by the paper work & said they have never seen anything like it. They have been in business for over 50yrs and very reputable. They had me call my bank. I then found out that the company taking the payments out each month was the company I had given access to my bank account. So went home and did some research and the car dealer I bought it from filed bankruptcy the previous summer. Then I learned that the owner of the dealership & 16 other individuals were indicted by a grand jury for 2several counts of money laundering car sales scams & drug deals. The IRS, FBI & Texas rangers as well as several police departments were involved. They were found guilty this past December. So needless to say I put a hold on the payments that were being taken out of my bank. I still had no contact with the company for several months. I stopped driving the car & went through with my plans to buy another car. I just left the car parked at my house and heard nothing for almost 10 months. Then I had some mechanical problems with the 2nd car I bought, so a couple months ago I went got tags and inspection on car that I was was involved int this crazy mess and began driving it again. While I was at the DMV there I told the lady’s at the registration office what was going on with the car and They suggested I do a Vin search. So I did. The car came back as owned by The owner of the car dealership we bought it from, whose is waiting his sentencing for 20 yr in the fed pen. And the lien listed was on the old finance company that went bankrupt. The company that the repo man said he was representing. I had never heard of.
Needless to say I called the police, which to my surprise they were not helpful at all, I went out to get my things out of my car while one of the repo men just kept telling me he did not have to let me get my stuff and they could have done been gone i ignored all of it. until he cam to the car door & said you give me the keys are I am gonna send you an $800 bill when we have another one cut. he was getting increasingly mad the cops finally showed up …of course they lied to the cops the cops told me to get out of the car and it was a civil matter they had hooked onto my car so they could take it. I tried to explain the whole story to the cops they did not care. So I called the local sheriffs officee and talked to them. next think I knwo the cops said get out of the car, they are gonna have to put the car down and get the proper paperwork and come back for the car. BTW both the repo guys had warrants for their arrest and the I heard the cops tell them and ask them did they know about that and they both said no….neither one of them wa arrested??????
First of all what is Breach of Peace and did the repo man do this? Second, can a company repo a car of they are not the named lien holder on the car?
Thank you so much for the answers here are some additional details that I think may be helpful.
The only one yelling was the “bad” repo guy. The other “good” repo guy was nice and was talking to me & we were trying to sort this mess out. The “bad” was yelling at me and became even more aggressive when he found out I was only no man lived here. the “good” repo guy was trying to settle him down. The more I did not get upset or show any emotion the more ticked he (bad repo guy) got.
Since the bankrupt company & the man heading to jail are on the title as the lien holder I did not understand if another company who Can not prove that they have legal right to the car can repo it. I have all my paperwork and even all the newspaper articles showing the scam this car dealership was doing and the charges filled against, and the article showing that they we all convicted.

for the last lady to answer my question, i think this will clear some things up for you….
I failed to mention that the sheriffs department made the repo guys release my car and leave my property… they did not have the proper paperwork & the loan company they represented does not have a lien against the car… the last legal lien was the company that is now bankrupt….. Furthermore, I did consult an attorney today and the repo drivers did break the law. You can not legally repo a car and commit a Breach of Peace, knocking on my door & yelling at 2:15am is exactly what that is! They both should have been arrested and the finance company they said they were representing is held responsible for their actions. I will be filing a complaint with the Texas AG.
I am not a deadbeat……. I paid the car as agreed until i ran into problems, and yes that was the only place we cold get a car, I had a child with a extreme illness in 2007, she spent a very long time in hospital and I missed

ok i took my car to a transmission shop they had such a good deal i couldn’t pass it up. $10 for a transmission drain and fill. When I went in there it seemed like they had no intentions on doing it for me i saw the man hooking up the diagnostic tool asked him why he said they do a 22 point inspection. NO codes came up. Ok overall those ppl were crazy they start telling me something was wrong wit my transmission and they would tear it apart for free and tell me what’s wrong with it. The dude even offered me a ride home. So i saw why their deal was so good it was a fish and bait scam they lure u in and convince you that you need a huge repair. I had the car inspected a week ago a paid inspection and he gave me a list of regular preventative maintenance things I should do and said engine transmission was very good.
Ooook so I left them my daddy told me to get out of there ASAP. The man at the trans shop said he would not do the $10 promotion for me. My car has been running just fine and 20mins after i left them the check engine light comes on!!! Im not sure what they did but I know he drained my transmission fluid and put it back in when I said no to tearing it apart. I was there for like a hour. SO the code is Throttle Positioning Censor (Low Circuit) I have no idea what this is or how it breaks I really need to know.
Is there a chance the mechanic broke it because he checked it 20mins prior and no code came up? Could their just be a short in wiring? Or a problem with the battery? (I cleaned the battery with baking soda this morning) The guy at midas told me it’s expensive to fix. Any way around this? And my car is not driving any different its still driving just fine but the light is on
yes i drove for about 20mins and the light came on. it wasnt on when i left them. midas gave me the code for free. he said it wasnt getting enough electricity which makes me think its a short in wiring or something not plugged although i looked and didnt see anything and yes the car is driving very good.

but ive heard VA and FHA can be picky as far as minor issues and wont let you close if they are not fixed, anyone know a site that will spell this out for me or know some issues that arose when you bought your home with them? the lender said VA and FHA guidelines are the same, so the appraisers look for the same stuff.
like ive heard that they wont let you buy if paint is peeling or there is not a railing on steps that have more than two stairs. must have GFCI outlets in the kitchens bathrooms and outside or garages. any other stipulations i should be aware of? just had our inspection done and want to know what i should ask for now since VA will want it done later anyways. to me i could fix most with a quick trip to home depot and a few tools, but not sure if VA feels the same

Open Question: very important…foster care?
A baby was placed in foster care, he is 7 months old, was born on drugs. The mom and dad are going to lose their chances because they keep failing drug test after drug test.
My friend is a stay at home mom who fell in love with this baby after babysitting for him before he went into foster care. the baby’s great grandparents have been raising him but the great grandma got sick and can’t anymore.
The great grandma would love if my friend was able to get him instead of him going to foster care.
My friend went to foster care orientation and is starting the process.
*If my friend passes everything in foster care will she definitely get this baby that she requested?

i dont understand. Resolved Question: buying short sale condo?
Hello,
I am so frustrated now coz of buying this condo. At first I put the offer in at 119k but the bank countered my offer at 130k and 3%back to the buyer. I put offer back the one they asked. But after that we found out that the seller has liens for 5300 and 15k. Me and my real estate agent negotiated back to the seller that they have to responsible for those liens and they agreed to do so.
But today I got the email from the seller agent that Bank already made final counter offer which if I agree to pay 3,300 (partially of the liens), the condo will be pending in the same day.
They said because the seller lost their jobs and they cannot afford it. but they will be responsible for the lien of 15k.
What should I do? The agent gave me choices..
1. refuse to pay any liens
2. pay part of it.
3. pay 3300 and get it pending inspection
The condo is so nice though.

Voting Question: What are the steps in buying your first house?
I am a first time home buyer. I am clueless on how this whole thing works. The agent that I have been working with, I am not very thrilled with. I really dont know if I am approaching this in the right order. And she has been less than helpful when it comes to explaining things. I explained to her that I am VERY new to this and will need a little bit of hand holding . Yet she does not explain things in laymans terms and has not really told me what I am supposed to be doing and it what order.
She had a finance person call me and that person was supposed to send me some paperwork to get the preapproval stuff going. I never got it. I followed up repeatedly and still have never gotten it. So I am going to try a different person that a different friend recommended.
Well… the realtor has me looking at houses now, but I thought they were supposed to help me find what I am looking for. Other than area and price range she has not really asked me at all what I am looking for. So… I have only looked at 2 houses so far. But I dont know what I am doing.
I know that if I like one I make an offer. And then if it is countered, I continue negotiations. Once it is accepted, I need to get the property inspected and appraised. But I dont understand what happens then. If the inspector finds something that needs to be fixed, we have already agreed on a price. So do we go back to negotiations? Or what? Seems to me like that should be something that is done before the negotiations, but if I had every house inspected that I look at before I make a bid, I am going to be one poor person.
I bought the book home buying for dummies, and I am reading it…. but I am not done yet. I would like to see if anyone can give me a summary so I know if I am skipping a step.
I have pulled my credit scores and while they are not wonderful, they are not bad. They are in the high 600s very close to 700. I do have some credit card debt, but it is not excessive. Not something I can pay off in a month or two though. I set my housing budget pretty low (which is why I think the realtor I am working with is less that helpful). I make about 70-75 k a year and I have set my house budget at 100k. I am looking for houses below 120 ask I know there is usually a lot of room for negotiation. I figure if I can keep the total below 110… I should not have any trouble with it. I used the mortgage calculator and my payments on a 30 year fixed would be in the 600s. After you factor in insurance and taxes I figure my house note should be somewhere between 1000-1100. Right now I am paying 900. I should not have a problem coming up with an additional 1-2 hundred per month.
And I know utilities will probably go up a little too.
Voting Question: Can I get an abandoned house by Adverse Possession?
I live in Alabama and I know every state is different, but I know someone who says he does this, but the county court house is not very helpful in giving me black and white of what I can and can not legally do.
I’m told that if there is an abandoned house I can claim adverse possession, pay all the property taxes that have built up, fix up the property to be livable, get a city inspector’s stamp of approval that it is livable then I can move into it or rent it out.
Then the real owner has X amount of years(10 in alabama) to come back and claim the property. After 10 years I can get the title for the property.
However while waiting on the real owner to claim or not claim the property. If I am living there I am saving myself a lot of money not having to pay rent or a mortgage somewhere else. Or if I rent it out I am collecting rent every month so I’m still coming out way ahead even if I don’t end up being able to keep the property.
Like I said someone I know does this and it sounds very lucrative, I’m wondering if this is actually legal. (a link to proof of your claim is requested if possible)

Open Question: Hurricane Shutters Inspection?
In 2006 I had shutters installed at my home. The company I used, Alpha Home Systems was licenced and insured and chraged $300 for obtaining necessary permits.
On February 4, the City of Doral posted a Violation Notice on my door stating that there was no permit on file for the shutters and the company was not licenced to work in Doral.

Voting Question: I bought a house cash. How long before I can refinance it. And criteria.?
I purchased a fixer upper (single family) well below fair market value 2 weeks ago. It is a long story, but basically the seller couldnt benefit from any of the proceeds of the sale and the longer it was on the market the longer he had to deal with selling this property and all that that entails, so he took my offer. I happened to be the only one to offer anything and it was for 1/8 of the asking price and they accepted. I used a reputable lawyer who performed a title search and I also purchased title insurance on the property. I am trying to build up my real estate porftolio and I found another house which a 3 family home (3 br’s per unit) that is beautiful. I had a home inspection done and it basically needs about ten thousand dollars in upgrades(some things for looks and some things that are needed ie hole in building and heating system, missing copper). I have done my due diligence average rents for 3 br in this town are about 950 bucks. They are asking 60 grand for it. The taxes are cheap at 1200 a year with the building currently being assessed at $195,000. I do like the property but I like it even more from a numbers standpoint. Also, I am a general contractor so I am capable of maintaining and fixing up these properties on my own. I bought the first house with all cash. I now only have about 10k to put towards this house. I have more money but not that I can use for this . The house I just bought is assessed at 115k, but realistically is worth 50 grand by an appraiser. Like I think stated earlier the 3 family family’s asking price is 60k, I offered 20grand they countered with 45 grand, I Held firm at 20 and they went down to 35. I came back with 30 grand as my final offer and they accepted it.
Long Story short, I want this house badly, it is a great financial opportunity for me but I need about 25 grand in cash to get it done. Can I pull it out of the house I just bought. Also the 3 family house will not conform to conventional lending because of fact it doesnt have water so it doesnt have heat, (how was winterized.) The house I want to refinance condition is that it is real ugly but everything works, however it is winterized so I wouldnt have to pay for heat. Please point in the direction on how to get this done and how to get it done quickly lol.

“What is it about buying a boat that makes people leave their brains at home?
Just curious… It seems every year about this time, (just after boating season starts). We all start hearing from people that just bought (both new & used) boats that don’t float, don’t run, don’t start, don’t stop, don’t plane, don’t turn, don’t tilt, etc. etc. etc.
I don’t know about you guys but I really feel sorry for these (mostly) novice first time boat owners.
What do you think? Are these people just leaving their brains at home when they go shopping for a boat? Or is it something else?

by Mr_R_Swi… /It is people chasing a dream. I knew nothing when I bought my first guitar at 15 years old, but I am a reasonably good player at 56.
I was early retired 2 years ago and decided to go for a job that I ‘wanted’ to do rather than one I ‘had’ to do. I went for a job making sandwiches for a catering company… but they said I wasn’t ‘cut out’ for it. Seriously! So I went back to my original profession and am now back working as an HR Director, on far more money than the owner of the sandwiche concern.
If I choose to buy a boat and ‘have a go’ at sailing it…. then I will do so. I don’t care what so called experienced ’sailor’ moans about it. I have also been a health and safety officer for many years… so don’t give me the old twaddle about everyone but you being a danger to all and sundry.
People buy boats because they want to, and are entitled to do so.
If you don’t like it… get a skateboard.

by Havoc Squad / Some certain circumstances of issues yes I do feel sympathy for used boat buyers, especially if its a very big problem hidden that a professional inspection misses.
However, for most scenarios of used boat purchasing, I got zero sympathy for burned boat/PWC buyers.
#1. People let the anxiety or adrenaline of boat buying and desire take top priority over their brain.
When this happens, people bypass doing research or verifying the quality of the vessel and get tunnel vision about the price or appearance of it.
#2. Impatience which also relates to #1.
Those with no training or experience in proper used boat shopping are most likely extremely impatient. Unless they have a large budget, rushing to find and buy a used boat always increases likelihood buying a lemon.
#3. Lack of wisdom
Most beginner used boat buyers do not understand the maintenance and repair hazards that could be hidden in a boat/PWC purchase. They also usually don’t understand how expensive marine repairs are as well.
Those are my three main observations.

I sold him a solid running 90 Ebbtide with a 75hp Johnson for $800 (+ $100 that i have to pay to landfill his boat). This poor guy bought his boat at the world’s biggest marina, Ebay. The problem doesn’t just lie with rookies, it’s pirates who take advantage them also. These crooks should be keelhauled,stretched on the rack, and their genitals set alight. We try to run our business by my grandfathers’ idioms, don’t screw people, and only let them screw you once.
If i could offer the newbies one piece of advice- don’t buy it until you drive it.

Resolved Question: Trying to transfer software from old computer to new one.?
I had to buy a different computer, and on my old one I had my Home Inspection software on it . The problem I have is I went to install the CD on my new computer and my activation code will not work anymore. I called the company to get a new code, and sure enough they are no longer in business.
My question is how can I transfer the software from my old computer to my new one? Can the geek squad crack the code if I took the software to them? By the way the software is about $400.00 so I really need to try to get it transferred from one computer to the other. both computers look just alike , but are different Dell models. the old one is a Dimension 8250 and the new one is Dell Optex GX280. The towers look identical. Any help would be great. Thanks

I am a 1st time home buyer and I have a contract for a home which I really like since it’s in a good location , huge and has lots of potential. Inspection found that the property needs roof repairs, termites treatments, leaks needs fixed and lots of fixture ups. We think it wont pass FHA loan until we fix all these. Can one counter a ‘home purchase contract’ during inspection period?
The home is bank owned sold ASIS? I expected to fix some stuff however, I did not expect to spend more than 1k for repairs to pass. I am not sure how much roofing repair is going to cost but I think around $12k. Can someone give me an idea or know any financial assistance programs in AZ? or, how I can convince the seller to lower selling price and ask my lender the diff for repair before eoe? Resolved Question: somene suing me, contract is evidence?
i sold my house to this first time home buyer nearly 2 years ago. today he emailed me and said that i was held responsible for broken roof tiles that cause water damages throughout the 2 years. He is suing me for “undisclosed” damages. The buyer emailed me that i signed a paperwork from the termite company that stated the release of liability for roof which i can see my signature very clearly. It did not mention any broken roof tiles, BUT ON THE BOTTOM, there was a big fat circle around “broken 122 pieces” in PEN. The termite company didn’t notify me about any broken roof tiles. I did not see that big fat circle when i signed the contract. There were only 1 copy of the release. The first time buyer emailed me again and said that on his home inspection report, it did not mention any roof tiles damages and questioned the termite company why the escrow company didn’t received that liability form. The termite company didn’t send the roof release liability to the escrow company. It funny how the owner estimated the 122 broken tiles last month, and on the release liability roof form it stated 122 broken pieces. How can the termite company have the same estimation which it was nearly 2 years ago. Anything could happened(heavy wind and rainstorm, earthquake, etc) Whose fault is it if we go to court?

Open Question: SUREW-ALL to “fix” horrible foundation?
I am trying to buy a house (older Victorian style home built in 1920). Had an accepted offer, then had an inspection done and the inspector said that the foundation is pretty much gone. In his words:
A majority of the brick foundation on the south, east, and west sides is heavily deteriorated. The brick foundation was visible in large sections where the concrete parging had pulled away, broke off, or was loose. In these sections, the mortar was heavily deteriorated and had turned to sand. I could take my pinky and run it through the joints as the mortar fell to the ground. This condition was observed in a majority of the foundation. There were some areas of the foundation so bad that the mortar was totally gone in large sections. There were areas on the south side that the bricks were loose on the outside row and 2nd row in. You could see the foundation visibly go downhill on the SE and NE corners. Where the concrete parging had pulled away, you could see a large gap between the top row of brick and the 2nd row down. This was visible along most of the south and north sides. In the basement, there were some areas that had been parged over to cover over the loose mortar. This is not a proper structural repair. The inside of the foundation appeared better than the outside, but you could still see the issues with it. The NE corner had spray foam applied in the open gaps through the wall.
Recommendation: Recommend having a licensed Foundation Contractor review and replace the deteriorated sections of the foundation…which is at least 3 of the 4 walls.
The Realtor said he would get an estimate from a contractor to take care of this, then sent me an email today stating this:
We had a foundation contractor look at the basement and it is his opinion that the wall would be structural sound by applying a product called Surewall to the exterior of the walls with the exception of the south wall which would need to have part of the wall removed and replaced.
I love this house but I am pretty sure SUREW-ALL wouldn’t fix this situation. Opinions? I don’t really want to continue this when it sounds like SUREW-ALL is more of a “cover-up”.
Any suggestions/experiences would be appreciated.

Resolved Question: Is a crack on the side of the townhouse is a serious structural problem?
I am about to make an offer for an end-unit townhouse. But when i was looking at the building from the outside, on the front side of the building at the corner there was a crack from the bottom up to where the siding starts. I took a pic of it and trying to figure out if it’s a serious problem. I am a first time buyer and had a problem with another place that we found out during the inspections. So if I can, I would like to figure this out before going through all the trouble. Thanks!
The townhouse was built in 2001, it faces southeast but the problem wall faces west. The base material is brick. The crack is vertical and just on where the front-covering brick meets the foundation brick. I wish I could have attach a picture. I think the siding is vinyl.
