Open Question: Just bought house now have plumbing issues.?
I just bought a house that has been completely redone. I moved in a couple days ago and already have a plumbing problem. I contacted my home warranty company and they said they will pay for the damage and new cement but not to replace the broken pipe (which is under my patio slab). Voting Question: FHA loan- home needs repairs?
Hello,
We are trying to purchase a house and think that we have found the perfect house for our needs. The problem is that we are approved for an FHA loan and the house needs some repairs. Another person put in an offer and during the inspection they found that there was about $5,000 in plumbing work that needs to be done. The property is bank owned and they are not willing to pay for the repairs. My real estate agent says that FHA will not approve the loan because of the repairs that are needed.
My question is if we can pay for the repairs out of our pocket or have it escrowed so that FHA will approve the loan? Or if we could offer $5000 over the asking price and then stipulate that the bank needs to repair the plumbing? Do you think that either of those options will work? If not is there any other way that we can get our house?

Resolved Question: My home is sinking and the walls are cracking and floors bowing, I need a loan asap to fix this! Any ideas?
We have lived here a year in May. Our real estate agent told us we didn’t need a home inspection. Yes, I know what a mistake that was and it is our fault we listened so I don’t need to hear about that! What I do need to know is if anyone can recommend any loans or ideas to get a loan where I can get the money to fix the problem before it gets worse and when I say worse I mean just crashing down around me, thanks! Our credit is shot right now because we got in over our heads with this house and fixing some other things as it is. OK, just some additional information… The joists are sinking and where the weight bearing walls are there are no beams, they are actually about 2 feet from those walls. This home was built in 1983 so it isn’t a new house. I have considered a lawyer but have no idea where to start with that and with my husband being deployed that makes it a bit more difficult! Ignoring Tradition

Is tradition important? Should we listen to our elders and continue to do what has been throughout history? Kids often ask themselves questions about the importance of the past. Chinua Achebe‘s “Dead Men’s Path” delves into the importance of tradition and how a young man reacts to some old - fashioned traditions. Tradition is something to be treasured and respected, although Obi illustrates neither action. Both culture and tradition are important, and should not be ignored or dealt with in the manner of Obi, the main character in Achebe‘s “Dead Men’s Path”; he thinks of tradition as disadvantageous to the school he works for and does not seem to care about the significance that this path holds for the villagers.
The young gentleman named Obi in the story seems to be a productive twenty-six year old who gets promoted to a high position at a school. His actions throughout the story prove that he obviously thinks that tradition is less important than what is happening at that moment. He believes that these villagers should not be using the footpath that crosses the school property he works at. Obi does not care too much about the tradition of the villagers and the fact that they have been doing this for generations. He looks at it as useless to him and his school, so why have it. The villagers try to explain to Obi what this path means to them. “Our dead relatives depart by it and our ancestors visit us by it. But most important, it is the path of children coming in to be born”(43).

Obi just does not care and blocks the path that takes the villagers to the place of burial. The theme of the story conveys that tradition should not be ignored, and that the history of certain things in life should not be forgotten, especially if it means so much to some people. Obi does not look at it from this perspective, and replies to them by saying “dead men do not require foot paths”(44). Obi is basically saying that dead men are not here right now so why should they care about them. It does not seem like Obi is doing this with the intention to harm these people. Obi takes advantage of the position of power he has at the school as a headmaster and does what he thinks is best, and that is to get rid of the path and make the area around the school beautiful. Obi seems to have a lot of confidence, and it almost seems like he has the mentality that no one can stop what he wants, and that is to show other people how to run The Ndume Central School.
It is interesting to see how something that means so much to a group of people can be ignored and looked at as not important by someone else. Sometimes one’s tradition and the way they do certain things is looked as weird and not ordinary by outsiders. “It amazes me that you people allowed the villagers to make use of this footpath. It is simply incredible”(43). Obi is speaking of the footpath without knowing anything behind it. My family fasts and donates money to the people that need it most at a certain time of the year. This is part of our tradition and it’s something that has been done for a long time period. I can’t imagine someone that does not know much about our culture at all, come up to us and tell us we cannot keep doing this.
Michael Obi is hired to help the school become progressive and successful. However, he does not accomplish this. Obi does not want the inspector to see random villagers around the school premises. He ignores the history and significance of this path by blocking it. What comes back to haunt him is the villagers getting angry about the situation, tearing down everything around the path and the inspector seeing this the next morning. Everything that Obi does backfires in the end and what he exactly hopes for not to happen happens. The inspector writes a bad report about the school. In the end it is his arrogance that gets in the way of his work. Obi thinks that he is the smartest person and that he could do no wrong, and we see that he loses everything because of this. If Obi left the path alone both he and the villagers would be better off.

Open Question: Water Leaking Coverage?
I recently bought a house in Oct 2009 (FHA Conventional) and everything was fine according to the inspection report…not leaks, no damage whatsoever except for drywalls here and there, but nothing major. Just last month, it has been raining pretty hard; water was leaking, dripping from or through the walls from master window and master bathroom window inside the house. At this point, I am unsure how much of a water damage or has spread to. My question is since I recently just bought it, is it cover until the title company since it is still within the 1st year or would I need to contact my home insurance company? Any insight would be greatly appreciated it! Thank you in advance.

Open Question: Audio shop messup caused damage to break power booster.?
I have a 2008 honda civic still under manufacturers warranty

While shoping around for an amplifier installation I stumbled upon this small shop that would install the amp for a decent price and the guy seemed trustworthy so I decided to give him a shot .

He did a great job installing the amp and when I tried to drive away I noticed the breaks seemed hard and spongy , having expirience with cars in my younger years I imediatly knew it was something with vacum or the power booster assembly , I drove back (barely) and after inspection he admited he may had drilled trough the power booster while looking for a way trough the firewall.After I helped him some we patched up the booster unit somehow and I was able to drive away home at least with no problems , he offered to pay for the repair as long as I did it with his mechanic and his parts , and it would take a couple of days to get the part over .

I’m a little worried , he seems like a nice guy and all but my concerns is that god knows what part he is going to get and from were , and I don’t know if any after market parts may void my warranty.

So my question to you guys is :

What can I do to protect myself just in case he tried to rig it and I’m not happy with the fix and/or

The mechanic trying to get any parts from my car since it’s new?

Also how about if I say screw it and take it to the dealer , what would be the way about suing for repairs if he refuses to pay and what can I sue him for ,?does a small store like that have to have some sort of insurance ? he did mention he had some ,but does he have to pay me by law? I only had the car for less than a month so it was recently certified by Honda to be in good shape so there is no talking his way out of this .

All I have at this point is a recept for the work done to the amp , should I file a police report or something ?

Resolved Question: $100 down incentive program HUD california question?
Ok, here’s the deal. A few questions hopefully someone can answer in a DETAILED format and not some quick over the counter answer. Serious answers only please as this is a serious matter.

I’m a first time home buyer. I’ve been searching for homes for quite awhile putting in bids and losing by a couple thousand each time or even worse, to cash investors.

I’ve turned to looking at HUD homes because I don’t have to worry about offering more than the appraisals or cash investors getting involved until after the owner occupant timeframe, giving me a chance to MAYBE buy my first home.

Here are a few questions that I can think of that no one can give me a simple, for dummies answer.

Accepted offer. what if I get a home inspection and it reveals problems NOT listed in the initial property inspection report, can i back out without forfeit or will HUD pay for repairs or adjust their price accordingly?

How much will the net be if i pay all closing costs? The house is in Southern CA, $115,000. FHA loan.
3.5% down - $4,025
6% closing/commissions/etc - $6,900
Total out of my pocket - $10,925 (this number is not exact, just a hypothetical)
Will the net still be $115,000 because I’m covering ALL my closing costs or is there some other formula for finding out that number?

If a property doesn’t have a big sign saying $100 down payment incentive, does any HUD home financed through FHA still qualify?

I’m working with GMAC Realty and Wells Fargo Mortgage, do I still qualify for the $100 down payment incentive? Is there a list of some sort that I can see that will show all APPROVED lenders/agents that I can use?

Upon closing, will i be receiving the hud document with all signatures or will i have to inquire with an attorney, of my own or theirs, to have all paperwork sent to me?

I will appreciate it greatly for anyone in the community who can take the time and answer these questions to the best of their knowledge.

Open Question: questions about landlords permission to come in?
i am having issues with my landlord of a residential property that i moved into in december. the landlord is an arrogant man that does nothing that is asked and also was very deceitful in the process of renting. So basically what is going on is that there are numerous things that are wrong with the property that were disclosed to me after the lease and deposit had been made as i was moving in. One of those is the garbage disposal. So i asked him to replace it the day i moved in on dec 1, 2009. it is now march and it is still not done. he made an appt with me for saturday the 27th of february to which i switched my schedule to be home (i do not want him in the house alone or with only my daughter) he called on friday said that he could not come because his friend (who he claims can do all the repairs cant make it and he will schedule another time) i then recieve a phone call either sun or mon saying that he will be there tues at 5 . i try to change my schedule to be there but cant so i call him on monday telling him that he can not come then because i will not be there and i do not want him in there alone . on tuesday he still has not responded to me saying that he is not to come so i email him saying that he is not permitted to enter the property and basically he says that because he gave 24 hour notice he could. our lease says this 20. RIGHT OF ENTRY AND INSPECTION: OWNER may enter, inspect, and/or repair the premises at any time in case of emergency or suspected abandonment. OWNER shall give 24 hours advance notice and may enter for the purpose of showing the premises during normal business hours to prospective renters, buyers, lenders, for smoke alarm inspections, and/or for normal inspections and repairs. OWNER is permitted to make all alterations, repairs and maintenance that in OWNER’S judgment is necessary to perform. what i want to know is can he really enter my house when i explicitly say that he may not enter because there is no emergency.

Voting Question: How Much Does Roof Replacement Cost? Estimate?
There’s a home we’re looking at in the Central Maine area- not huge. About 1000 square feet or so, bungalow style. We just had a post-contract inspection (we can get out of it if there’s a major issue) and the inspector told us that there are three layers of shingles on the roof, and that they need to be “stripped” and a new layer put down. I have NO idea of what kind of cost we’re looking at. Is this big enough to warrant scrapping the contract? I will of course get some professional estimates later in the week, but can anybody clue me in as to what we MIGHT be looking at cost wise, especially in the Millinocket area if you’re familiar with Maine. Labor rates etc? Is this likely to really reeeeally expensive? Any insights would be appreciated.

Resolved Question: what kind of contractor do I need to call?
I had my current home inspected and buyer wants me to fix those. I have no clue who I need to call. I am not even sure if those need to be fixed. Inspection report says get it checked by contractor and repair if needed. If someone can guide me, i’d appreciate. If i can, I want one contractor to do all.

These are list.

1.) Please have a qualified licensed plumber inspect and repair hot water heater
combustion air vent that is blocked in the attic as this is a potential fire hazard. In
addition the TP&R valve line was kinked during time of inspection. As described on page 5
of 6 of inspection summary.
2.) Please have a qualified professional repair the gas valve at fireplace that was inoperable
(too tight to turn). As described on page 2 of 6 of inspection summary.
3.) Please have a qualified licensed electrician repair missing knock outs at panel in garage
as this is causing wires to rub and is a potential fire hazard. As described on page 3 of 6
of the inspection summary.
4.) Please have a qualified professional contractor evaluate and repair a bowed strut for the
top ridge beam located in the attic. As described on page 1 of 6 on the inspection
summary.
5.) Please have a qualified professional repair the furnace flue pipe that is not adequately
supported in the attic. As described on page 4 of 6 of the inspection summary.
6.) Please have a qualified licensed plumber ensure that hall bathroom is no longer leaking
as signs of past leaks have occurred. As described on page 5 of 6 of the inspection
summary.

Resolved Question: Can I claim points paid by the seller at closing on my taxes?
I want to confirm the details before I go searching down anymore rabbit holes…

I purchased my first home in August. I have looked at the rather confusing IRS flow chart to determine whether or not the 2% in points paid by the seller can be claimed by me, the buyer, on my taxes, and I’m still not sure if I meet criteria, although I think I am… and I’ll be honest, I’m not exactly sure what most of the criteria actually means, but I took my best guess. If anyone can translate the IRS statements below in plain English, I’d be most grateful.

First, details:

* $209K = purchase price
* 6% = total amount contributed to closing by seller
* 4% = amount applied to closing costs and insurance, 2% = amount applied to points.

I worked the deal so that I didn’t have to pay a nickel out of pocket for the home and used my VA loan, so the seller practically paid me to take their short sale. The VA stipulates that the seller cannot contribute more than 4% to closing, but can contribute to points above 4% as long as it is not “excessive,” thus, I was able to apply the entire 6% to all points and closing costs.

1. Your loan is secured by your main home (your main home is the one you live in most of the time).
(YES, IT IS.)

2. Paying points is an established business practice in your area.
(ANY REASON IT WOULDN’T BE? HOW WOULD I DETERMINE THIS ANYWAY?)

3. The points paid were not more than the amount generally charged in that area.
(I WOULDN’T THINK 2% IS A LOT FOR TAMPA)

4. You use the cash method of accounting. This means you report income in the year you receive it and deduct expenses in the year you pay them.
(I’M AN REGULAR TAXPAYER… 2009 IS MY FIRST YEAR NOT USING A 1040EZ!!)

5. The points were not paid for items that usually are separately stated on the settlement sheet such as appraisal fees, inspection fees, title fees, attorney fees, or property taxes.
(ALL POINTS WENT TO INTEREST)

6. The funds you provided at or before closing, plus any points the seller paid, were at least as much as the points charged. You cannot have borrowed the funds from your lender or mortgage broker in order to pay the points.
(DOES THIS MEAN NO EXTRA MONEY WAS BORROWED TO PAY POINTS TO REDUCE INTEREST? I ONLY USED WHAT WAS PROVIDED BY THE SELLER AT CLOSING)

7. You use your loan to buy or build your main home.
(I ONLY HAVE ONE HOME - FIRST TIME BUYER)

8. The points were computed as a percentage of the principal amount of the mortgage, and
(YES)

9. The amount is clearly shown as points on your settlement statement.
(JUST RECEIVED MY STATEMENT, AND THE AMOUNT FOR 2% IS INDICATED)

There is one additional statement that confuses me… “Points paid by the seller may be deducted by the buyer provided the buyer subtracts the amount from the basis, or cost, of the residence.”

Does this mean I reduce my purchase price by ~$4000? Will this affect my first-time home buyer credit? Due to my income, I don’t qualify for the entire credit, but if I must deduct the interest from my purchase price then will this affect the proportional amount I’m eligible for?

Lots of questions, but its all relevant. I do plan on having a tax professional prepare my taxes this year, but I would like to be moderately prepared in advance before leaving it in the hands of a complete stranger! Thank you in advance for any and all assistance.

Resolved Question: 1996 Subaru Legacy Wagon Front End Problem?
Hi, my mechanic is not in town today and I don’t want to miss out on a potentially good deal,
There is a 1996 Subaru Legacy Wagon AWD f/s. The person is asking $1500. He describes the usual for a car this age–fair/good interior, recent work done, good NJ inspection until 2011.

However, he does note the following in his ad: “New front wheel bearings, brake rotors. I replaced both axle shaft assemblies as well but must have done something wrong as the front end feels tight when turning sharp. I don’t have the time or resources to figure it out.”
He notes that driving straight does not present this problem.

I was wondering if indeed this was something that he might have done wrong and can be put to rights relatively easily or could it mean a major problem? Of course we would have our mechanic go over it if we decide we like the vehicle but since it is quite a drive from our home to see it, I’m hoping someone here might have some thoughts on what this “tightness” might mean.

Resolved Question: What are some good tips to avoid being pulled over, or to attract the attention of Police on the Highways?
I am thinking of driving home for Christmas. From Indiana to NYC, Eastbound on 70, going Rt 71 North in Ohio, and taking the Ohio/Pennsylvania Turnpike straight through, and coming out by Exit 6 of the NJ Turnpike and going North. Now, I have NJ Plates and a current Inspection sticker (Orange, May 2010) and i Promised I would not be getting another Ticket.. i simply have had my fill.

Since i think there MAY be “More” Cops on the road around the Christmas holiday, i was wondering if anyone would share (whether it be active or retired Officers or patrolmen/women) or Experienced Drivers that have been around longer than myself (I am 27) as to how to make my car, in essense, simply a car passing on the road that would be of no interest to a Policeman.

I usually drive 70MPH whether the Speed Limit is 65MPH or 70MPH in the Right Lane, as the road IS two lanes at some points, and Try to keep a car in fromt of and behind me. IF i am all alone and drive past a tropper camped out on side of the road, i slow down by coasting to 65MPH, the Speed Limit.

Anything else i should do? Or Thoughts?

I am confuse because I am planning to buy a car though craigslist but i am not sure if its true or fake. I send an email to a seller and they responded back saying this:

At the moment I’m stationed at Hancock Field AGS an US Military AFB in Syracuse, NY. making final preparations before deploying to Iraq with the U.S. Convoy

The car is already at our Military Logistic Department form Fort Belvoir, U.S. Army base near Bethesda, MD, crated and ready to go. The Logistic Department will deliver the car to your home. Since the car is in a military base, with no access you can not go there and take it, only the Logistics Department can deliver it, because the car is in their custody.

Shipping may take anywhere between 1-2 business days depending on the destination.. All documents you need for ownership, loog book , manuals and bill of sale will be provided along with the vehicle.
For the payment I would like to use Yahoo as a third party. They will keep your money into a protection account until you get the vehicle and will release it to me after inspection period is over and you agree to keep the car. So, this is not a blind transaction, you can see the car before committing to buy and to eliminate any concerns you will have 3 days to inspect it. If you decide not to keep it Yahoo will refund you the money, no questions asked, and shipping back will be my concern. I think this is more than fair for both of us.

Open Question: when buying a home when do you sign a binding sales contract?
Okay, I’m thinking of buying a home the final week that I can get benefits.

This is what the government says

….However, in cases where a binding sales contract is signed by April 30, 2010, a home purchase completed by June 30, 2010 will qualify

So after I decided on the house and negotiate a price, it it just as simply sign on the dotted line? Like do you have to do anything before I sign? The inspection would be after signing right? It only takes a like a day for this process of signing right, assuming you have already choosen a house?
When I said something about doing this signing thing, this would be the last week of April…. closing just needs to be before June 30

Resolved Question: HOMEOWNERS… I need your opinion. What is your thoughts on a roof maintenance program?
Hi! My husband and I own a small roofing company and we’ve had a number of customers have inquired if we have roof maintenance program. We’ve never really considered it but I got to thinking about it and I would like more feedback from homeowners on the matter to see if it’s worth our time.

Most homeowners know that you really need to keep your roof clean as much as possible to extend the life of your roof. For example, the longer you let leaves sit, the more water will sit under the leaves and the more chance you have to developing rotten wood and leaks.

We were considering offering a Maintenance Program where we would visit a home quarterly (more or less depending on the roof) and clean up the roof and gutters as well as a thorough inspection plan. We would check the life of the shingles/metal, pipe boots, wood rot, etc each time.

It would kinda be like a pest control service.. we’d do the service and leave a bill on the door. Our thoughts were around $50 each visit or $120-ish for the year if they prepay.

Please give me your thoughts.

Resolved Question: How to kill and prevent rats and mouse in my attic?
I heard some noise yesterday afternoon and then today a pest control inspector came to my home to do an inspection. He went up to the attic and found some indications of rats/mouse. For example, some holes in the attic insulation. He checked outside of my house also and suggested to seal several gaps. He mentioned there might be only 2-3 rats/mouse in the attic and it seemed like the activity just started recently.
This guy asked for $540 for the rat/mouse treatment plus the gap sealing around the house. Is it too expensive? Is it difficult to deal with the mouse or rats in the attic?
Any suggestions?

Resolved Question: Listing agent playing games with us? Help!?
My fiance and I have a bid in for a house owned by Bank of America of 105k. They countered our offer saying they won’t pay for FHA fees for 135, a pest inspection, Section 1 repairs and saying we have close by Jan. 22. There are 2 other offers on this home both FHA loans (as is ours) and before they countered our offer, they had the listing agent ask ours if we would sign a contingency saying if the house didn’t appraise for what we bid, that we would pay them the difference in cash.

We didn’t sign it and that’s when they countered offer us a day later. About two days later, the listing agent told our agent that the bank countered another offer and now it has been about 3 days and she hasn’t told our agent anything else about what is going on leaving us completely in the dark.

We were almost sure we got this house and I fear that the listing agent or bank or someone is playing games with us. It almost seems to me that the listing agent may be trying to get a friend or client of hers to get this house.

What should we do in this situation? Is there anyway we can find out what is going on? Is she or the bank playing games with us? If we haven’t heard anything back from them for such a long time does this mean we will probably not get it?

Our actual agent is out of the country so we have been working with her agent so I am begging for someone to help that has some more experience under their belt :(

Resolved Question: new car temporary plates and no inspections sticker?
yesterday i bought a car off a dealer and he gave me a temporary plate but then when i brought it home i realised they had removed the inspection sticker.
i then called and he told me that your allowed to drive the car with no sticker as long as it has the temporary plate on the back… then once i receive the title and registration etc.. i should go get it inspected which is in 2 weeks…
so can i drive the car with a temporary plate and no inspection sticker? i live in the state of New Jersey.

Voting Question: Is there any way to speed up the process of a short sale in New Jersey?
Recently, I signed a contract to purchase a home in New Jersey. A week before the closing my lawyer called to say that the closing must be postponed due to a “seller issue.” Now it comes out that the seller must apply for a short sale. None of this was brought to my attention prior to the signing of the contract. I have already spent a lot of money on homeowners’ insurance and the house inspection and must wait indefinitely for the closing. Is there any recourse I can take against the seller for his dishonesty and the loss of money? Also, how can I work to speed up this process? My main concern is moving into the home as soon as possible.

Voting Question: How Much Does Roof Replacement Cost? Estimate?
There’s a home we’re looking at in the Central Maine area- not huge. About 1000 square feet or so, bungalow style. We just had a post-contract inspection (we can get out of it if there’s a major issue) and the inspector told us that there are three layers of shingles on the roof, and that they need to be “stripped” and a new layer put down. I have NO idea of what kind of cost we’re looking at. Is this big enough to warrant scrapping the contract? I will of course get some professional estimates later in the week, but can anybody clue me in as to what we MIGHT be looking at cost wise, especially in the Millinocket area if you’re familiar with Maine. Labor rates etc? Is this likely to really reeeeally expensive? Any insights would be appreciated.

Resolved Question: sewage backup, I have a huge problem.?
First off, I rent, I donot own this duplex. Earlier this morning I went downstairs to see my neighbour and noticed there was a few inches of water coming from their laundry room. I knocked and nobody was home. So I phoned the landlord and told him, he told me to call a plumber asap. So I did just that. I went back upstairs to perform a few tests because I was concerned it was sewage. It did not smell very bad, and it did not smell the best either so I thhought maybe it was tap water. I tried the taps and it seemed a little bit of extra water came out. I tried the toilet and BAM, quite a bit of water poured out. So I called my landlord back and told him it was toilet water coming out, and he told me tophone the city too since they were working on the street this morning. So a few hours passed and finally the city truck shows up. They told me they can’t do anything tonight because it was waste water and they sent the wrong type of truck. The guy told me the health inspector is gonna have to be called, and they might end up having to do work to the house. So, my neighbour returned home, and I immediately told him the situation. He talked to the landlord and told him he was gonna have to call the health inspector since he has kids down there and doesn’t want his place unfit to live in. The landlord told him if he did that, he was gonna have to move out. Then the landlord came over and started sucking out the waste water in their place with a shop vac type vacuum, and dumping it on the front lawn. Firstly I wanna know if it’s gonna be a health hazard for me (drinking water?), and what me and my neighbour should do about the situation? It seems to me like our landlord is trying to make the place look good enough for the health inspector so he isn’t forced to pay for all the damages properly. He’s been down there sucking gallons of waste water out for hours now and just casually pouring it onto the lawn. Thoughts? questions? BTW, I live in Alberta, canada so our laws with thhis kind of thing are probably different. But I’d assume it’s a environmental hazard for him to be pouring sewage onto the front lawn, and against the law for him trying to ccover his tracks so he doesn’t have to pay for new drywall or anything.
