Resolved Question: Landlord skipped town right before court date?
So back in mid-January, our ceiling started leaking from the kids light fixture. Landlord was blase about it, and didn’t do anything but give us a bucket. So I called the fire department. They said shut off the breaker, and get it fixed (to the landlord).
He’s refusing to fix anything til spring.
The short version is, we’re going to court next Friday, because the building inspector came in and said let it go to court and try to get your filing fee returned to you and get a rent abatement for the time you haven’t been able to use the room (kids are sleeping in our room, we’re in the livingroom).
Landlord since patched the ceiling, but building inspector said it’s not enough. The leak came from the roof, which he doesn’t want to fix. I’m not the only person in this building- it’s about 4 apartments in a heritage building.
So…. we get a note on our door yesterday morning from the landlord, saying he will be out of town until APRIL 4th!! Our ceiling is not fixed and we have a court date for this coming Friday. I can’t see him sending a lawyer in his place, since he doesn’t want to spend money (his reason for not fixing things) and if he doesn’t show, we get everything we’re asking for, and probably more. He left us the number for his brother who lives in town, but all calls to him have yet to be returned (he’s a slum lord anyway, but….)
SO…. in all likelyhood if he doesn’t show and no one shows to represent him, we will get everything we’re asking for. BUT, the ceiling/roof won’t be fixed until spring- his plan all along.
Now I live in Canada, so the rules might be a little different from those in the states, but what do you ladies think might happen? Would the adjudicator allow us to pay to have someone fix it and then the landlord has to pay us back? Would they order his brother have it fixed? Would we just get all our rent back and be told to wait?
Will he be charged/fined for not fixing things? He’s going to get nailed for turning the office space up front into a residential space without a permit (according to the building inspector who saw it).
And, what do we do in the meantime what with not actually having a landlord for our building? I know we’re not going to have to pay rent on the first of March and April (since we hand it directly to him), so we’re going to bank it and let it earn interest and might not even have to pay him anyway…..
Also we have a friend who’s a contractor who would totally fix it for us. He charges $40 an hour, but sometimes gives a deal. He would not give this guy a deal (he doesn’t like him), and would charge him full price.

handsome- he already said he’d have us evicted so his son can move in, but they wouldn’t allow that wile this was still outstanding. and even if he did, he wouldn’t move his son in, in which case (we’d find out) and he’d have to pay our rent for a year at the new place, moving costs, and storage fees for a year.
he’d hate that, but we’d love it.

Resolved Question: Rental Business: should a special home inspector inspect an apartment building OR can I use a regular one?
Hi,
I’m looking into buying an apartment building (say 10-plex).
Wanted to ask if I can use a regular home inspector for the inspection OR since it is bigger (10-plex) do I need a different inspector?
In other words, is there a certification called “apartment building inspectors” or is any certified residential inspector supposed to be qualified for that?
(asking about residential use only, not commercial. just more units)
