Open Question: Recourse against selling realtor and contractor?
I recently purchased a house and feel that I was slightly taken advantage of. During the inspection, the inspector stated that he believed the heating system (oil furnace) needed replacing but could not truly assess it because the seller didnt leave one drop of oil. We told the selling realtor that we could not test it and that it needed replacing and that I would not purchase the home; he offered to put in a few gallons and have a plumbing contractor (who worked for him elsewhere) come look at the system and give us an estimate. The contractor was able to fire it up and told my realtor and I that it only needed about $300 worth of parts and wrote that the system was “showing minor signs of stress and should be watched over the next year or two for signs of additional wear and possible replacement”. Taking his word (which I had questioned my realtor about if we actually should since he worked for the selling agent who obviously had an interest in selling the place) I went forward and purchased the house.
Now, a month later I have been told by three contractors that nobody should have stated that $300 would fix the problem, and the entire system needs to be replaced as it is cracked and completely worn beyond repair, to the tune of over $6,000. Since this was my first home purchase, and it took everything I had to make this purchase, I will have to take an additional loan out to pay this, which will make it very difficult for me financially.
Do I have any recourse? I feel like I have been seriously misled. This was a bank-owned so I can’t go back to the “seller” but feel that the selling agent took advantage of me, knowing that I knew nothing about home repairs and that I had told him I would not purchase the house if I’d had to have the system replaced. Any thoughts??

Resolved Question: Waste water keeps coming back through my furnace overflow pipe!?
I have a sump pump system in the house I just bought. We wouldn’t have bought this house if there were knowingly sewage problems. The home inspection report said everything was ok. Same when Sears came and installed the washing machine, ran a cycle, and everything was ok.
For the last month we’ve been working on the house the plumbing has never given us any problems. Well, there were some plumbers digging new lines for a house being moved to the empty lot next door last Friday. On the Sunday after we found out now OUR plumbing is screwed up:
Whenever I run the washing machine, the sump pump trap fills up, pumps it out, when it fills back up again quickly, it can’t pump it out and it sprays out all over my unfinished bathroom in our basement! (our furnace is on the main floor, so the open pipe is right up next to the ceiling, and soaks my subfloor). It doesn’t do this with running faucets or flushing the toilets.
We called the city to be sure the main sewer line wasn’t collapsed. It’s fine. So, we had a plumber in here Monday to “jet” out whatever blockage may be causing the backup. He tested it, everything checked out fine. Now it’s doing it again 2 days later. The plumber said he can almost guarantee it’s because of tree roots. I don’t think it’s a coincidence that the neighbors did new lines and suddenly we’re having problems when everything was fine for the last month.
Does anyone know what this could be?
(Just so we’re clear, I will be using a tree root killer tonight before I go to bed. Also, I’m probably going to be calling the plumber back tomorrow to do a camera inspection).
I don’t think you can sue a home inspector in Nebraska. You’re hiring him and taking his advice at your own discretion.
Besides, all the other loads of laundry I did before the neighbors dug new pipes did not cause any problems.
Resolved Question: home inspections/corporate properties?
i am about to put an offer on a corporate woned property that doesnt offer home inspections, and the property is sold as is. If they accept my offer and i conduct my own home inspection, can i back out of my contract if i find a major strucuture concern or failure of a dye tests.
