thanks!
thanks AdvilsDevocate.

i was pretty sure this was a scam, just by the way it was worded, he was offering me 200 bucks for everything, and its only worth about 100 or so, so that gave it away, plus the way he worded it was weird.

thanks alot, i was just double checking.

Voting Question: Can I be charged with breech of contract if my wife alone signed consulting agreement and was the client?
My wife hired a home inspector to inspect our home for obvious structural defects; we needed the damages in writing. At the end of the inspection the inspector had my wife sign a Consulting Agreement. In the agreement it states… Any written report summarizing our findings and opinions will be provided to the client and will be copyrighted by me and is and will remain my property. It states… this agreement is a personal agreement between you (my wife) and the inspector. No person other than you (my wife) has a right to rely on the contents of this agreement or on any report for any reason whatsoever. It also states the agreement is a binding legal agreement. My wife is listed as the sole client; my name is never mention.
After receiving the report it was apparent we didn’t get what we paid for. None of the possible defects or obvious structural defects was mention or included in his inspection report. My wife sent the inspector via certified mail, a questionnaire asking him about defects which wasn’t included or mention in his inspection report; she also sent along pictures to refresh his memory, she asked for a refund if he choose not to respond to the questionnaire. The inspector didn’t respond or give a refund
I filed a complaint with the BBB. In the inspector’s response to the BBB each paragraph starts with “Mr. Jackson states” and the inspector response is suggesting my complaint to the BBB wasn’t truthful; he also states the questionnaire my wife sent to him was threatening. I am sending a copy of the questionnaire along with the pictures that my wife sent to the inspector to the BBB to prove the questionnaire wasn’t threatening as suggested by the inspector. I would also like to send a copy of the inspector inspection report to the BBB to prove I didn’t file a bogus complaint as suggested by the inspector.
My question is… Does the Consulting Agreement my wife signed and is listed as the sole client, pertains to me? Because the inspector is accusing me of filing a bogus complaint and the inspector inspection report is proof that my complaint is not bogus; can I send a copy of his report to the BBB to prove my complaint against inspector is not bogus without being sued for breech of contract by the inspector? My wife was his client and she alone signed the consulting agreement? Please advise, THANK YOU.

Voting Question: What would you do in this situation?
Hello,
My husband and I have been searching for our first home for 6 months. Many bids later, our offer was finally accepted on a bank owned foreclosure. We were thrilled- and then came the inspection. Although it was in pretty good shape, the air conditioner is not working and is over 15 years old.

Since we’re FHA buyers, our mortgage broker told the seller that they won’t finance us unless the AC is fixed. We contacted 5 different AC guys, who all told us if it was 15 years old and dead that it needed to be replaced. We had one of them go out to the home to confirm this. We shared this with the listing agent, who informed us she had already fixed it. We responded that we’d spoken to 5 people who said it would have to be replaced and that this would be a dealbreaker for us. So, we sent an inspector in who informed us that they had pumped it up with freon, that an AC certified tech never would have done that, and that it would break again in a matter of days. We had that report, along with an estimate, sent to the seller and requested a credit toward the AC.

My understanding is that the real estate agent committed fraud by having it pumped up with AC and then trying to hide the fact that it was still broken from us. She is royally pissed that we didn’t accept what she said at face value and is telling us that the selling bank wants 5 estimates provided at our expense (We’re almost positive that this is a lie because she responded to our earlier statement that we’d spoken with 5 AC guys by saying she wanted all 5 estimates, which wasn’t what we said we had in the first place.)

Anyway, we’re new to buying and just wondering if anyone knows if we have any rights in this situation and if there’s someone we can speak to other than the listing agent to see if they really want 5 estimates. Also, is this something that we could file a complaint with the licensing board over? She’s making our lives hell right now so if it is a complaint worthy offense then we might consider it. Thanks so much for any advice anyone has if they actually read this til the end!
