Open Question: Can I Sue My Landlord for Uninhabitable Living Conditions Due to Black Mold?
My boyfriend used to be a contractor and notified my landlord of leaky pipes and excessive moisture that can cause mold a couple of years ago. He said he would send a contractor over to fix it, but never did. My boyfriend told him several times how dangerous it could be, but his notifications went ignored. Now, my sister who lives with me, has developed cancer on her ovaries. But within 2 mos. time, it spread to her lungs. She has developed lung cancer; (doesn’t smoke or is even around smokers). The oncologist claimed that she cannot identify a certain spot on the MRI of her lungs. She was referred to an immunologist/allergist that specifically identitifies ASPERGILLUS (toxic mold spores). I have had increased sinus infections, mucus, severe headaches, bloodshot red eyes and these are all symptoms of toxic black mold irritation. We notified our landlord again, and he sent unlicensed workers to tear down the area and rebuild over the mold without treating it. He obviously doesn’t care anything about the health of his tenants. Can he be sued for negligence? We both have severe issues caused by the mold exposure. Finally, we are moving. But what can we do about him? We have documented everything with photos and memo’s of our conversations. As well as personally hired a mold inspector and contacted the city to inspect the property. Each inspector claimed that the landlord showed gross negligence in his actions to get rid of the problem. Can we sue? What should we do next?

Voting Question: Mold In Home A/C Air Handler?
My wife and I purchased this used house about a month ago. Before the purchase the home inspector alerted me to a leak had been repaired hours before his inspection. The repair was at the elbow of a drainpipe coming from the bottom of the air handler, going through the crawl space, and exiting into an adjoining wall. After moving into the home, I began to smell a damp smell coming through the air duct when the air conditioner was in operation. In addition, all three of us have quite sensitive noses and began to show signs that something was amiss,. I began to inspect, looked into the crawl space and found no evidence of a current leak but there was a lot of dust, dead cockroaches, and a similar damp smell. I also took the panels off the air handler and noticed mold all over a motor, which I suspect, is the blower and one side of the evaporation coils. Since this is a 3-ton system (the a/c is a fifteen year old Ruud and the air handler is an old Tempstar) in a roughly 2,100 sq/ft home in Mississippi, I was seriously considering replacing this system in a couple months. The system is cooling but does not cycle as often as I think it should. I have been all over YAHOO! asking questions so I know many of you are tired of reading my posts. I had planned to order a system from an online company called Alpine and getting a contractor to install it. Now I am assuming that my air conditioning ducts may need cleaning too and it may be more prudent to pay retail with a local company that not only installs systems but also cleans air ducts. In an effort to improve the air quality a bit, I was thinking about getting a mask, shop vacuum, gloves, bleach and water solution, sponge, and evaporator coil cleaner and cleaning the coils, blower, and crawlspace until we are ready to replace the system. Am I correct in my assumptions can anyone give me prudent advice?

Resolved Question: Is Our Real Estate Agent trying to rip us off? HELP?
My husband and I are 1st time home buyers, we have been looking around for a few months. Well we finally found a house and it is great, except for the basement. It seems to leak here and there and there is some mold or mildew on the bottoms of the walls in one of the room. Every time we bring it up to our agent she thinks that is really not a big issue. Well we had our meeting the other night and signed the contract. We found out that our agent’s boss who is the owner of the company bought the house at a sheriff sale. It was listed at 164,900 and she told us that he would go to 150,000 with 6% assistance for closing but nothing less. So we made our offer for 150 with 6% assistance and a home inspection, termite and radon are contingent. So we can walk away if the inspection is real bad about the basement. So that is the only issue, the basement. So when we were there the other night she said we just had a home inspection go through earlier this week and I saw the invoice it was only 250, if you want to use him I will get you his number. She said he is a builder in town and does home inspections. So since the price sounded better than the other guys we said sure that’s fine. So she came back with his card!
Ok the next day (yesterday) she emailed me the ratified contract back and said that it was accepted. So I called the home inspector that she gave us and told him who I was and he said, ” I already know I talked with your agent she called me earlier and it’s the house on _______ Road right?” I said “yeah” and he said, “Your agent told me you were in a hurry so why don’t we do it this Thursday?” I said, “Ok” bla bla we set the appt up. Why would she call? I thought I was supposed to as the buyer and he was supposed to be a neutral 3rd party? I just feel like this whole think is a conspiracy!! What if he is “in on it” and he will say that there is no leaks it was just a busted pipe or something? Because we physically saw the water coming from the walls after a hard rain, we go to the house a lot to look around. I did check and he just became an associate with ASHI according to their website. Does anyone have any advice? Is it unusual that our agent already contacted the home inspector prior to me? Should we get someone else that they do not know? Our inspection is tomorrow night! I do not want to get taken advantage of because we are young and new at this.
I did not know that her boss the owner of the agency owned the house. I’m pretty sure that she told us after she went over the contract but I don’t think that we signed yet. I asked her about the history of the house, then that is when she told us.
Also, she said we can give her the earnest money after the inspection. They have no money from us yet. The contract says, “500 dollars earnest money upon ratification. It has already been ratified though; she said bring it in to her after the inspection.
I know the mold and mildew is really bad, but we were hoping that the owners would give us some assistance to fix it and the rest of the house from what we see is good. It was built in 1990 and the foundation is poured concrete.
Thank you all VERY much for your input! I would like to say that I canceled our appointment with that home inspector!! I did research and talked to a few people and found a new home inspector and made a new appointment with him! He told me that he would be concerned too, our agent should have gave me about 5 different names and let us research and choose what we think is best. I talked with a friend of mine and he said that he heard about the same real estate company doing the same thing to others about the inspection! I am glad that I talked with him, and everyone that gave me advice on here! Thanks again
