Open Question: Ticket question?? I’ve been out of the US for school since 2006 and took my car in 2007. I had a?
I’ve been out of the US for school since 2006 and took my car in 2007. I had a Mexican decal that automatically renewed annually with my student visa. Well, upon returning to the states with my car in July 2008, the border patrol agent mentioned my car tags were expired (as of April 2008), but I informed him that I had a student visa and a Mexican decal. He checked it out and said that I was fine and shouldn’t have any trouble since my visa didn’t expire until 2009. Well, I took my car through inspection upon returning to my city and received my certificate, and was going to get my tags, but the place closed. I had to go to another city in my state about 200 miles away b/c my grandfather was in the hospital and wasn’t doing too well. I figured I’d be fine since I had all of my paperwork with me. Well, a cop mentioned my tags to me while in transit, and I informed him of my decal and all and he said I should be fine. Well, I was going to head back home after about a week or so, but he went back into the hospital so I stayed. I was leaving the hospital and stopped at a store nearby to get some medicine and when I returned, a cop was writing me a ticket. I explained everything to him, but he said he already started writing the ticket and that it should be thrown out once I showed compliance.
…Well, I received the ticket Aug. 20, 08 and got my tags on Aug. 25, 08. I tried paying the ticket around the 1st of Sept. but it wasn’t in the system online, so I called in and the clerk said she couldn’t find it and to try back in a month since I have about 45 days to pay it. I still tried checking online a couple more times in September. Around the 2nd or 3rd of Oct. 2008 I went online to pay it and still nothing was there. I called back and explained everything to the clerk and she couldn’t find it, she said that it’s voided after 45 days and not to worry about it, as he must have thrown it out or didn’t turn it in or something. Well, I’ve been busy with school and haven’t thought about it since. I’ve since renewed my tags for 2009/2010 and thought all was well until I received a letter in the mail in July of this year saying I had 10 days to pay $227 or else my license would be suspended as a result of an unpaid ticket. I called and this clerk said that something was mailed out in June 2009 mentioning a filing error from LAST YEAR and gave me the opportunity to pay, well, I’ve been out of town, my family was out of the country, and I didn’t get a letter. I wrote them a nice letter and included copies of everything and now I have a “court date” in Sept. I just want to either have it thrown out and not go to court as I’ve NEVER had this problem before or just pay the original $42 admin cost and $24 nullification fee. What should I do?? No contest? Not guilty? Basically, I’m glad I stayed in the city b/c he passed away on Thanksgiving 2008.
Open Question: What would you do in this situation?
Hello,
My husband and I have been searching for our first home for 6 months. Many bids later, our offer was finally accepted on a bank owned foreclosure. We were thrilled- and then came the inspection. Although it was in pretty good shape, the air conditioner is not working and is over 15 years old.
Since we’re FHA buyers, our mortgage broker told the seller that they won’t finance us unless the AC is fixed. We contacted 5 different AC guys, who all told us if it was 15 years old and dead that it needed to be replaced. We had one of them go out to the home to confirm this. We shared this with the listing agent, who informed us she had already fixed it. We responded that we’d spoken to 5 people who said it would have to be replaced and that this would be a dealbreaker for us. So, we sent an inspector in who informed us that they had pumped it up with freon, that an AC certified tech never would have done that, and that it would break again in a matter of days. We had that report, along with an estimate, sent to the seller and requested a credit toward the AC.
My understanding is that the real estate agent committed fraud by having it pumped up with AC and then trying to hide the fact that it was still broken from us. She is royally pissed that we didn’t accept what she said at face value and is telling us that the selling bank wants 5 estimates provided at our expense (We’re almost positive that this is a lie because she responded to our earlier statement that we’d spoken with 5 AC guys by saying she wanted all 5 estimates, which wasn’t what we said we had in the first place.)
Anyway, we’re new to buying and just wondering if anyone knows if we have any rights in this situation and if there’s someone we can speak to other than the listing agent to see if they really want 5 estimates. Also, is this something that we could file a complaint with the licensing board over? She’s making our lives hell right now so if it is a complaint worthy offense then we might consider it. Thanks so much for any advice anyone has if they actually read this til the end!
