Resolved Question: Need advice on buying a foreclosure/short sale!?
In a sticky situation and I need some advice!

Hubby and I put in an offer on a short sale in January, thinking we would have plenty of time to close, since we were hopefully going to do so March 20. Unfortunately the seller was an idiot and failed to give her lender the paperwork in a timely manner. So now we’re in this situation: We can accept a pre-closing occupany for this home in which we will move in the end of April and live there rent free until the closing of the sale. The downside is there are quite a few renovations that need to be made. The only thing that has to be fixed before we live there is the small amount of mold in the basement. However, it is likely that the roof needs repaired and the garage needs major rehab. Plus we would have to pay for an inspection and if should anything fall through we would be out that money.

Our other option would be to put in an offer on another home, not a short sale. We have to be out of our apartment at the end of April, but we would like to get out in the middle. If we would buy a foreclosed home (one that is REO, bank owned property) how long would it take to close? We already have several picked out, but my husband is worried about the timing. We’ve already been pre-approved for the money for a mortgage, and have the right connections for lawyers and such (Hubby’s uncle is a real estate agent). I’m just looking for a straight answer and what would you do? I guess I should also ask how long does it take to close if the home is not a short sale or a foreclosure since I am a first time home buyer. Help!!! We’re ready to move!

Resolved Question: House is unlivable and can’t afford to make required repairs?
A friend of mine has owned a 2 bedroom 1 bath home in Pennsylvania for about 8 years. They owe 140,000 on the house right now and are able to make the mortgage. However, they gutted the house and found black mold and after more inspection found the foundation and Sill of the house to be completely shot. They had the house on the market before they found all these issues and they were unable to sell. Her husband who is a contractor stated it would cost them way too much to repair the damage to the home with out going completely in the whole financially. She is at her wits end and is contemplating walking away from the house and renting. Has anyone had this experience? Is there anyway the home could be deemed unlivable by a County Inspector? If it is condemned/deemed unlivable how would a mortgage company handle this? Is there any way to walk away from this house with out having huge repercussions? They can not sell the house at this price, they can not refinance because of the real estate market. Have the Foreclosure policies changed to help people who are in this type of situation?
Thank you to “Fay” for having such an intelligent answer to my question. Yes they have heard of Bleach. They did try that, the mold was inside the walls and rotten under the Sill Plate, def.-wood member that rests on foundation wall and is attached to it with anchor bolts. Floor joists and header are attached to it. This rotted, foundation is crap now
. The home passed inspection when it was bought. Until the sheet rock was removed the black mold was not noticeable (obviously) . They already contacted the Ins. Co.-NOT COVERED (mold isn’t covered) Fed HUD for grants-NO GRANTS & their Mortgage Co. -COULD NOT HELP THEM. I asked a serious question and hoped to get knowledgeable replies, its obvious you know nothing, so please do not comment. Leave your ridiculous comments to yourself. Better Yet why don’t you open a cleaning business since you THINK you know so much. BTW- Mold can crow in the cleanest of homes, it just needs moisture.
Their house will not appraise for what they owe on it. They Refi’ed a few years ago and leveraged the house. Nothing is selling around here. Plus, since they completely gutted the house there are no rooms, only a bathroom an bare studded walls. They had planned on remodeling the house but now they are in a sticky situation with the rot and mold. They can handle the mold situation but the cost to repair the Sill, and foundation would be too costly

Resolved Question: The seller’s attornrey is not returning my deposit for real estate transaction?
I was purchasing this bed & breakfast in upstate NY, once my offer was accepted by seller i went in contract to buy with contingency terms ( like inspection, mortgage approval etc) I had given 10% deposit almost 70k to sellers attorney to be held in trust account then i went in to get the property inspection and i found like lots of problems some were black mold, bad saggy roof, crawl space had water almost 1 ft deep and structural problems after seeking advice with my attorney i decided not to buy this property so my attorney sended a notice to seller attorney based on contingency i am not interested in buying this but seller attorney is not willing to give my 10% deposit back , so i am looking for an advice in this can i file a complaint or report to government service so atleast i could get my deposit back , Please advice!!!!!!!
By the way i use the realtor who was also the listing agent , she is saying once the seller’s attorney says the deal is off she will returned some portion of deposit she is holding?
