Open Question: Breaking lease due to Black Mold and caving in Ceilings?
Hello, i have been in a battle with my landlord for a year to make repairs, I hired an attorney (which I latter found out is working with my landlord on securing a mortgage for one of her real estate clients, she’s an agent) and we sent a certified letter with a list of all needed repairs, that are severe, the most being severe mold in my daughters (both rooms) bedrooms. One room has severe water damage from a leaky roof (which we orginally told her about a year ago) and has severe cases of black mold. It is unsafe per the inspectors report for us to live there, even a week longer. Can I move out, and set up a court date, myself, to be officially out of the lease? The certified letter was sent in March, I live in Illinois, if that helps.
She even refuses to fix the caving in ceiling in the living room. Plus their are electrical conduits poking thru holes in the walls all over my older daughter’s room, which the inspector stated was “Completely Illegal” I just don’t want to be responsible for the remainder of the lease which I have been in this home since November of 07 lease expires June 1st 2010.
Id id ask my lawyer. His Idea was to not pay rent at all, wait for the 5 day notice to pay, and then vacate, he said I wouldn’t owe any money for the remainder of the lease if I left within those 5 days. I’d only lose my security deposit, I however felt that was wrong and paid the rent
Hello, first of all I did not renew the lease, like i said i signed the lease for 2.5 years off the bat. The inspector, is a licensed mold inspector/home inspector in the state of Illinois, he did test for mold. And he said it is black mold. So no it is not harmless, he said basically that most of the home has water damage and walls and ceilings need to be replaced as well as the roof. (which I now have raccoons living in, they dug a huge hole through). My lawyer, yes, is not the smartest one, and yes is a LL.
Elias, thank you, my new lawyer, stated that to run not walk out of this place, and that since I had sent her a certified lettter almost 2 months ago about the mold and nothing was done, that because of this I can leave. I have the mold inspector’s report, the lab results, and notes from my daughter physician. But leave all my belongings? Or just soft stuff, like clothes and blankets, most others can be cleaned with that non bleaching clorox spray right?

Voting Question: Is it common to have some mold on the floor joists of an older home?
We are in the process of buying an older, but larger home. The inspector that looked at the property mentioned in his report that there was some mold on the floor joists in one spot, or so it seems to be localized. I’ve heard that this is common in older homes and that the majority of it is harmless as long as its not concentrated or black mold??? Now we aren’t sure if we want the property.

Resolved Question: Mold in new home i purchased.?
i bought a house and within 1 year found the crawl space full of mold, the house inspector made note that there wasnt any in the home. what can i do legally if anything?
but there was no evidence that the inspector was in the crawl space, the only way in was stapled to the flooring, he never checked it in the first place.
