Resolved Question: I have submitted an offer to buy a foreclosed home here in AZ. The house needs some repair work?
such as: missing appliances, dirty swimming pool, tile/carpet in one of the closets, a few shingles on the roof and the wood siding on the outside of the house needs replacing in two very small areas. My real estate agent told me these repairs could keep the loan from going through because it is an FHA.
Is this correct? What does the bank look for in an inspection? Can the repairs be made before the inspection? My agent has not been helpful in answering my questions and seems to give me more reasons why the loan can’t or won’t go through rather than reasons why it can or how it could. I do not want to get financing for the repairs as I would like to do them myself if possible.
Open Question: Multiple questions on purchasing a foreclosed home?
I am looking into purchasing a foreclosed home for under $25k in the Sacramento, CA area. Will I be able to quality for any loans if I am currently unemployed? I am in a healthcare training program with a prospective career). I know I should contact a Real Estate agent first (do I have to pay for agent’s fee?). Where can I go find a reputable real estate agent? Do they have to be from the area where I want to purchase the house? What are the next steps if I find a foreclosed home that I am interested in? Do I have to hire an inspector (how much does it cost and am I responsible for paying them?) and an appraiser? What comes after the inspection? How can I avoid any possible liabilities (taxes, outstanding debt/mortgages) left behind from the previous owner? Am I completely free from any outstanding dues/debts of the previous owner? Thanks in advance!
Open Question: Should we lose our earnest money?
On Feb 28 we signed a contract to buy a home. The seller accepted our price, but did a counter offer with revisions to closing costs etc. On March 2 my husband signed the counter offer. That same day we found out the loan we had been prequalified for had expired three days prior. We no longer qualifed for the loan. The following day we were offered military housing on base. My husband canceled the contract for those two reasons & we would be more financially stable without owning a home. The JAG office told him to cancel the check for the earnest money. On March 19 the realtor office called saying that the other real estate office the house was listed with wanted a money order for the amount of the earnest money ($1170) by the following day or they would get the DA involved. We called the DA & were told they don’t deal with those kind of matters. Every lawyer we called for advice were affiliated with one of the two realtors so we didn’t get any advice. My question is since we didn’t qualify for the loan, and canceled the contract the following day should we forfeit the earnest pay? Is there a grace period afte signing the contract? The constingcy we signed states “Time periods for investigations, Inspections, and Reviews and Financing Supplement Agreement shall commence on March 10, 2009 (Time Reference Date), regardless of the date the contract is signed by Buyer and Seller.”

Experiation of Buyers Right to Cancel Contract
Failure of buyer to complete one of the following shall constitute acceptance of the Property regardless of its condition:
a) Perform any investigations, Inspections or Reviews
b) Deliver a written list on a TRR form of items to be treated, repaired and replaced; or
c) Cancel the contract within the time periods in Investigations, Inspections or Reviews Provision.
Since the contract was canceled before March 10 wouldn’t that mean we are in the clear?
Again, the loan we qualified for expired on Friday. We were trying to sign the loan on Monday. We tried to get the loan & were told we didn’t qualify.
We were serious about buying the house, we wern’t trying to waste anyones time. We were told we couldn’t get the loan at that point anyways. According to the bank we didn’t qualify for the VA loan because we no longer qualified for the specific ratios they require. We didn’t back out because of post housing. Trust me, I would rather have my own house with my own rules. It just happened to fall into our laps at that point in time.
